ORAL ORDER
This Writ Petition is filed by the petitioner seeking
following reliefs:
“a) Issue a Writ, order or direction, in the nature of
certiorari quashing the Final Selection List bearing No.
UNIBE:MAMAAE:AUMKAAKA/AUM.SA/AUM.AA.PATTI/2025
-26 in dated 13.03.2026 so far as Sl.No.5 Rendal Thot
ANNEXURE-G
Center-173 showing as re-notification vide
issued by Respondent No.2 and 3 and the Notification
dated 14/05/2026 bearing No.SHI AAYOO

writ petition in the ends of justice.
c) Issue any other appropriate writ/s, order/s or
direction/s, as this Honble Court deems fit in the facts
and circumstances of the case secure justice.”


2. Heard Sri. S. G. Kadadakatti, learned counsel
appearing for the petitioner and Sri. Sharad V. Magadum,
learned AGA appearing for respondent Nos.1 to 4- State.

3. Facts germane to file the present petition are as
under.

4. The committee constituted for selection of
Anganawadi workers/Anganawadi Assistants of Chikkodi
Taluk, Belagavi District, called for the applications to the
post of aforesaid Workers and Assistants in respect of
Rendal Thot Kerur Centre-173, by notification dated
15.04.2025. The petitioner herein applied for the post of
Anganawadi worker, reserved for Rendal Thot Kerur
Centre-173. Subsequent to processing and scrutiny of the
application, the name of the petitioner reflected in the
provisional list against Rendal Thot Kerur Centre-173 on
18.11.2025. Surprisingly, on 13.03.2026 when the final
list was published in respect of Rendal Thot Kerur Centre-
173, the same is shown as re-notification, however,
without assigning any reasons for the same, which made
the petitioner to issue a legal notice on 06.04.2026.
Despite the same, the respondent proceeded to issue a
notification, inviting applications for Rendal Thot Kerur

Centre-173 of Kerur Panchayat in Chikkodi Taluk.
Aggrieved by the same, the petitioner is before this Court.

5. At the first instance, this Court on 16.06.2026
passed the following order:
“The petitioner's counsel has brought to the notice
of this Court that, though the petitioner's name was
reflected in the provisional selection list pertaining to the
appointment of Anganwadi Worker for Chikkodi Taluk, in
the final selection process, the said post has now been re-
notified without considering the petitioner's candidature.
This is the petitioner’s primary grievance.

The fresh notification has been issued despite the
petitioner's name being reflected in the provisional list,
and no reasons are forthcoming as to why the said post
was treated as vacant and the impugned notification
came to be issued.

The matter requires deeper examination.

Accordingly, there shall be an interim order of stay
of the operation of the notification dated 14.05.2026,
bearing No. SHI AAYOO CHI/ AUMKAAKASA/ ARJI/ AA/
2026-27, insofar as Sl. No.2 of Rendal Thota Anganwadi
Centre-173 of Kerur Panchayat issued by Respondent
No.4, till the next date of hearing.

Learned AGA shall secure instructions and an
explanation as to why the petitioner's name was dropped
despite being reflected in the provisional list, by the next
date of hearing.

List the matter in the Preliminary Hearing Fresh
Matters List on 06.07.2026.

I.A. No.1 of 2026 is allowed. Production of the
certified copy of Annexure-J is dispensed with for a period
of four weeks.”


6. In view of the interim order, though the
applications were called for, the same is kept in abeyance
so far as Rendal Thot Kerur Centre-173. The State
Government has filed its objections, wherein it has stated,
by means of Annexure-R2, the reason for
re-notification in respect of Rendal Thot Kerur Centre-173,
is the objection submitted by one Smt. Padmavati Walake
@ Padmavati Gadade who has secured highest marks in
PUC and a widow. Her application was rejected on the
ground that the application filed was incomplete. The
reason stated for re-notification is as under:

7. When the matter was listed before this Court on
21.09.2026, learned counsel for the petitioner submitted
that, the person who has objected for selection of
petitioner in the provisional list has been selected as
Anganawadi Assistant in Kerur Gavdyanvadi Centre- 29
and by means of provisional list issued on 20.08.2026 and
by means of order dated 24.09.2026, appointment order
was issued, since no objection was registered against her
appointment as Anganawadi Assistant. On his submission,
this Court passed the following Order:
“Learned counsel Sri S.G.Kadadakatti appearing
for the petitioner submits that candidate who has made
objection and at behest of whom fresh notification came
to be issued w ithdrawing the earlier notification wherein
the petitioner has been selected as ‘Anganwadi Assistant’
by means of provisional selection list issued. He submits
that he would produce the said document along with
proper application after serving an advance copy of same
on the learned AGA.
List this matter on 06.10.2026, in the meanwhile,
the said document be produced after serving an advance
copy on learned AGA on or before 30.09.2026. The
Learned AGA to secure instructions in that regard before
the next date of hearing.
Interim order granted earlier is extended till the
next date of hearing.
List on 06.10.2026.”

8. Learned counsel appearing for the petitioner
filed an application, producing the documents on
26.09.2026. Annexure-N produced along with the
application clearly shows that so far as Rendal Thot Kerur
Centre-173 Anganwadi Centre is concerned, no
proceedings have been contemplated stating that the
matter is pending before the Court. However, the objector
to the provisional list Smt. Padmavati Walake @
Padmavati Ravindra Gaded was appointed as Anganawadi
Assistant in respect of Kerur Gavdyanvadi Centre- 29 by
means of appointment order 24.09.2026. This position is
not disputed by learned counsel appearing for the
Government. Be that as it may, the reason assigned for
re-notification is unsustainable, that apart preposterous.

9. The only reason assigned is the request by the
person whose application was rejected on the ground of
incomplete information and that may not be a
circumstance to reject the candidature of a person who
has been otherwise held eligible and selected by means of

provisional notification, such an exercise of power
amounts to arbitrary and illegal that apart colourable
exercise of power.

10. The records clearly show that, though the
notification was issued, no process/steps has been taken
against the same, in view of stay passed by this Court
stated supra.

11. In that view of the matter, this Court proceeds
to pass the following:
ORDER
allowed
i. The Writ Petition is .

ii. The impugned Annexure-G dated
13.03.2026, so far as petitioner is
concerned in respect of Rendal Thot Kerur
Centre- 173 is set aside.

iii. The respondents are directed to process
the candidature of the petitioner from the
stage of provisional notification and issue

appointment order in accordance with law
within a period of four weeks from today
and report the compliance to the registry.
