praying for issuance of a writ of certiorari calling for the records on the file of
the 2nd respondent herein in Na. Ka. No.14283/ A1/ 2010 dated 28.8.2013 and
to quash the same.

ORDER
This writ petition has been filed challenging the order dated 28.08.2013
passed by the second respondent in Na.Ka.No.14283/A1/2010.
2. It is the case of the writ petitioner that he was originally appointed as
Librarian Grade – III on 23.07.1987 and promoted as Librarian Grade – II on
21.08.2002 and thereafter, promoted as Librarian Grade – I on 21.06.2003. As
per the sanctioned pay, he is receiving salary till such time. All of a sudden, on
the basis of an order dated 04.10.2013, enclosing an impugned order dated
28.08.2013, the date of promotion of the petitioner was changed to Librarian
Grade-II and Grade-I and consequentially, pay fixation was altered to that
effect. The above said alteration of date of promotion or the pay fixation was
done without giving any opportunity or notice to the writ petitioner.
Challenging the same, the writ petitioner is before this Court by way of this writ
petition.
3. The respondent has filed a detailed counter in which it is stated that the
change in date of promotion and pay fixation was done only subsequent to the
orders passed by this Court in various writ petitions. The respondent further
stated that now the matter is pending before the Hon’ble Supreme Court of
India and hence prays for the dismissal of the writ petition.

4. On perusal of the records, this Court finds that no notice or opportunity
was given to the writ petitioner before issuing the impugned order. On the basis
of violation of the principles of natural justice, the order impugned in this writ
petition is set aside and the matter is remitted back to the second respondent.
5. This Court further observes that there is no need for any personal
hearing to the writ petitioner. However, the second respondent is directed to
give one opportunity to the writ petitioner to submit his written explanation.
The petitioner shall co-operate with the second respondent and submit his
written explanation forthwith. After receiving the explanation from the
petitioner, the second respondent is directed to pass a fresh order in accordance
with law uninfluenced by any of the observations made by this Court in this writ
petition, within a period of four weeks from the date of receipt of a copy of this
order.
6. With the above observations and directions, this Writ Petition is
disposed. No costs. Connected miscellaneous petition is closed.
