ORDER
The Writ Petition has been filed to direct the respondents to consider the
representation made by the petitioners dated 24.09.2025 and 26.09.2025 for
issuance of patta.
2. The case of the petitioners is that they are working as construction
laborers for the past 40 years and do not possess any residential property of their
own for their livelihood. Hence, the Chairman, Secretary, Treasurer of the
petitioners’ Association namely M/s.Tamilnadu Construction Labor Central
Association, Sathya Nagar Branch (Registered vide Registration No.948/MDS
and having branch registration No.1033/1994 at Kovilambakkam) purchased the
subject land admeasuring an extent of 9 Acres, in Survey No.109, situated at
Chengalpattu District, Chengalpattu Taluk, No.8, Karanai Village, from one
K.Arunachalam by way of an unregistered sale deed in the year 1998 in favour
of the petitioners’ Association. Thereafter, the said land was divided into 374
plots and allotted to all the members of the Association, in which the members
have constructed houses and residing without any hindrances. On 30.08.2010,
the petitioners along with all the members of the Association filed a petition

before the 4 respondent seeking individual patta in favour of them for the
subject land. The Revenue Inspector conducted a field enquiry and confirmed
that the members had been residing on the property for over 16 years and

forwarded a communication to the higher officials to initiate steps for the
issuance of pattas. However, no effective steps were taken by the authorities.
Hence, another representation was made through their Association to the
respondents on behalf of all its members on 11.12.2024 seeking issuance of
pattas by taking into consideration the livelihood of the members who have
been residing on the property for over 30 years. Despite the same, the
petitioners neither received pattas nor received any reply from the respondents.
Hence, the petitioners have approached this Court by way of the present Writ
Petition.
3. Mr.M.Sivavarthanan, learned Special Government Pleader appearing
for the respondents one to four submitted that the nature of the subject land has
to be first ascertained. Further, the revenue authorities need to verify whether
patta can legally be granted in favour of the petitioners and whether they are
entitled to the relief sought.
4. Heard the learned counsel appearing for the petitioner and the learned
Special Government Pleader appearing for the respondents one to four.
5. It is trite law that no one can claim a patta over a piece of land as a
matter of right, merely by virtue of being in possession thereof. In the present
case, since the nature of the subject land is not known, it is for the competent

revenue authorities to first verify the nature of the land. Consequently, the
respondents are directed to consider the representations made by the petitioners
dated 24.09.2025 and 26.09.2025 for the issuance of patta, and pass appropriate
orders on merits and in accordance with law, based on the specific facts and
circumstances of the case, after verifying their entitlement, within a period of
sixteen (16) weeks from the date of receipt of a copy of this order.
6. With the above observations and directions, this writ petition is
disposed of. No costs.
