COMMON ORDER
Challenging the order dated 01.08.2026 of the Principal District
and Sessions Court, Thanjavur, hereinafter referred to as ‘the Sessions
Court’ for the sake of brevity, passed in Crl.MP.No.4214/2026,
cancelling the earlier bail granted to them, the revision
petitioners/respondents/accused have filed their respective Criminal
Revision Petitions as under S.438 BNSS.
02. Learned Additional Public Prosecutor, when these Criminal
Revision Petitions came up for final hearing, raised a serious objection
challenging the maintainability of these criminal revisions.
03. Learned Additional Public Prosecutor would submit that
since the impugned order of the Sessions Court passed in Crl.MP
No.4214/2026 cancelling the earlier bail granted to the revision
petitioners/respondents/ accused is of interlocutory in nature, all these
criminal revisions are barred under S.438(2) BNSS.

04. Fairly conceding that these criminal revisions are not
maintainable, the learned counsel appearing for all the revision
petitioners would require this Court to convert these criminal revisions
into criminal original petitions under S.528 BNSS.
05. Akanksha Arora V Tanay Maben (2024 INSC 962) is a
case where the Hon’ble Supreme Court has approved such conversion
as under:
‘7 . This Court has, in a catena of decisions,
provided that nomenclature of a petition is immaterial and
for doing substantive justice, the High Court can always
convert a petition under Section 482 CrPC to a revision
under Section 397 CrPC and vice versa.’
06. Therefore, having regard to the aforesaid decision, and
considering the impugned order being interlocutory in nature, this
Court is inclined to convert all these criminal revisions into criminal
original petitions under S.528 BNSS.
07. Ex consequenti , all these Criminal Revision Petitions, in
order to prevent aberration of justice and to promote substantial cause

of justice, are hereby converted into Criminal Original Petitions under
