stated to have been carved out of Survey Nos.110/2A and
115/2B, situated at Venkateshwar Colony, Raichur Taluk

Srinivas Rao, was the absolute owner in possession of
various plots formed in the lands bearing Survey
Nos.110/2A and 115/2B, situated at Venkateshwar Colony,
Raichur Taluk and District. It is further averred that the

the records maintained by respondent No.3 – Corporation,
as evident from Annexures-B and B1.
4. The records indicate that the petitioner’s father
executed a Registered Gift Deed dated 19.04.2023 in
favour of the petitioner in respect of Plot Nos.57, 58 and
66. The said transaction is also reflected in the
Encumbrance Certificate at Annexuer-C1.
5. It is also averred that the private respondents in
the aforesaid writ petitions approached the respondent -
Municipal authorities claiming right over the subject plots
on the ground that they have purchased the respective
plots from one Iqbal Ahmad, claiming to be the original
owner thereof. The private respondents assert that they
acquired title to their respective plots under separate
Registered Sale Deeds.

the other private respondents in the connected writ
petitions assailed the mutations standing in the name of
the petitioner’s father before respondent No.2 – The

Raheem and Abdul Salam S/o Osman Ali, under different
Registered Sale Deed executed in the year 1985.
8. Respondent No.2 - the Regional Commissioner,
while considering the revision petition filed by the private
respondents, has recorded reasons that the subject plots
were carved out of land that had been converted from
agricultural to non-agricultural use vide order dated
18.02.1984. Thereafter, the planning authority approved
the layout, and the Chakubandi (boundaries) mentioned in
the Sale Deeds of the private respondents were found to
have tallied with the plots referred in the approved layout
plan. On this basis, the Regional Commissioner proceeded
to allow the revision petition, while doubting the
Registered Sale Deed dated 06.11.1973 and consequently,
the Registered Gift Deed executed in favour of the
petitioner.
