WP No. 42344 of 2026
2.The petitioner claims ownership over 2204 square feet of land
comprised in Old survey No.838 and New Survey No.90/1 situated at
Thirumullaivoyal Village, Ambattur, Taluk, Thiruvallur District, having
acquired through a sale deed dated 30.03.2012. The petitioner executed a power
of attorney in favour of S.Nagarajan in respect of 1102 sq.ft. out of the said
property. The petitioner alleges that the fifth respondent, who is stated to be
working as a surveyor in the office of the VAO, is attmpeting to trespass upon
the said property by relying on forged documents. The petitioner submitted an
online application on 11.06.2026 seeking a fresh, definitive survey and
boundary demarcation. However, the fourth respondent has neither initiated the
survey process nor responded to the petitioner’s representation. Hence, the
petitioner has filed the present writ petition.
3.The learned Additional Government Pleader appearing for the
respondents one to four submitted that if a specific time frame is fixed by this
Court, the third respondent will consider the petitioner’s representation and pass
appropriate orders on its own merits in accordance with law.
4.Heard the learned counsel appearing for the petitioner and the learned
Special Government Pleader Pleader appearing for the respondents one to four.

5.In view of the limited nature of the order proposed to be passed and the
relief sought, notice to the fifth respondent is dispensed with, and this Writ
Petition is taken up for final disposal at the admission stage itself.
6.Without going into the merits of the property claims made by either
side, this Court deems it appropriate to dispose of the matter by directing the
third respondent to entertain the petitioner's online Application No.
2026/0178/01/000315, dated 11.06.2026 and conduct a fresh, field survey and
boundary demarcation of the petitioner’s land, which is the subject property
herein. The third respondent shall direct the fourth respondent to measure the
property strictly in accordance with the relevant Field Measurement Book
(FMB) sketches, revenue records and the parental title deeds of the parties. The
third respondent is directed to issue notice to the petitioner as well as to the fifth
respondent and any other counter-claimants or adjacent land-owners, fixing the
exact date and time for the physical inspection and measurement. Both the
petitioner and the fifth respondent shall be given a fair and full opportunity to
