For Non-applicant
: Mr. Jitendra Shrivastava, G.A.
/State
Hon’ble Shri Justice Rakesh Mohan Pandey
Order on Board
28/10/2026
1. The applicant has preferred this first bail application under
Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for

2
grant of regular bail as he has been arrested in connection with
Crime No. 359/2024 registered at Police Station Mulmula, District
Janjgir Champa (C.G.) for the offence punishable under Sections
103(1) and 238 of BNS.
2. Case of the prosecution, in brief, is that the deceased
Dhaneshwari Koshle was married to the Applicant Satyam Kosre,
and on 20.10.2024 at about 12:50 p.m. the applicant quarreled
with the deceased and assaulted and strangled her with a rope
and hanged her with a scarf (chunari). The deceased was
thereafter taken to CHC Aklatara wherein she was declared dead.
Thereafter, the brother of the deceased registered a merg on
20.10.2024 on the basis of which FIR was registered on
16.11.2024 against the present applicant.
3. Mr. Anmol Gupta, learned counsel appearing for the applicant,
would contend that the applicant is innocent and has falsely been
implicated in the offence. He would further argue that there is sole
eye-witness of the incident, who is one of the children of the
applicant and the deceased, and he has been examined before
the trial Court and there are certain contradictions and omissions
in his deposition which shows that the child witness is a tutored
witness, therefore, his statement cannot be wholly relied upon. He
would also contend that charge-sheet has already been filed,
there is no criminal antecedent of the applicant and he is in jail

3
since 16/11/2024 and since conclusion of trial is likely to take
considerable time, the present applicant may be released on bail.
4. On the other hand, Mr. Jitendra Shrivastava, learned counsel
appearing for the non-applicant/State, would oppose the bail
application and submit that the said child witness has categorically
stated in examination-in-chief that his mother was dragged by his
father to another room and thereafter, he hanged her by using a
scarf (chunri). Thus, since this is a case of commission of serious
offence like murder and there is an eye-witness account, the
instant bail application is liable to be rejected.
5. I have heard learned counsel for the parties and perused the case
diary.
6. A perusal of the statement of witnesses particularly the deposition
of the child witness who has been examined before the trial Court
would show that he has categorically depicted the incident and
stated that his mother was dragged by his father to another room
and thereafter, he hanged her using a scarf (chunri).
7. Having considered the facts and circumstances of the case,
seriousness of the offence and the role of the present applicant
which has been depicted by the child eye witness in his statement
before the trial Court, I am not inclined to release the present
applicant on bail.
8. Accordingly, this bail application filed by the applicant – Satyam
Kosre who has been arrested in connection with Crime No.

4
359/2024 registered at Police Station Mulmula, District Janjgir
Champa (C.G.) for the offence punishable under Sections 103(1)
and 238 of BNS is hereby dismissed .
