CAV ORDER

(PER: HON'BLE MR. JUSTICE S.G.PANDIT)

The State-Authorities in Higher Education
Department are before this Court. In W.P.No.2527/2025,
the challenge is against the order dated 26.02.2024 in
Application Nos.1848-1862/2022 C/w 10341 to
10347/2023 and 20300 to 20304/2023, whereby the
impugned order dated 04.02.2023 (Annexure-A13),
withdrawing the monetary benefits from the date of
eligibility and granting monetary benefits from the date of
the order, is quashed with a further direction to grant
monetary benefits from the date of eligibility. In
W.P.No.34390/2024, the challenge is to the order dated
29.02.2024 in Application No.4505/2022 passed by the
Karnataka State Administrative Tribunal at Bengaluru
granting similar relief as stated above.

2. The brief facts of the case are that the
respondents herein who are Librarians, Lecturers, Physical
Education Directors, Assistant Professors, Associate
Professors working in the Government First Grade College

WP No. 2527 of 2025
C/W WP No. 34390 of 2024

were considered for promotion/placement under Career
Advancement Scheme (for short “CAS”) under UGC
Regulations 2010 and 2018. Under Government Orders
dated 30.10.2021, 01.01.2022, 14.02.2022 and
19.09.2022, the respondents were promoted under CAS
and were granted monetary benefits from the date they
became eligible. On 29.09.2022, the State Government
issued a letter directing that the monetary benefits under
CAS promotion shall be prospective i.e., from the date of
the order of promotion under CAS and not from the date
of eligibility. By another letter dated 03.11.2022, the
State Government withdrew the earlier order (granting
monetary benefits from date of eligibility) and issued
revised order, granting monetary benefits prospectively.
Accordingly, the impugned Government Order modifying
the earlier order dated 19.09.2022 was issued. Under the
said modification order dated 04.02.2023, the monetary
benefits granted from the date the respondents become
eligible on acquiring qualification was withdrawn and it
was given effect to, from the date of order i.e.,

WP No. 2527 of 2025
C/W WP No. 34390 of 2024

19.09.2022. Aggrieved by the said order, the respondents
were before the Tribunal and the Tribunal under the
impugned order allowed their applications. In terms of
clause (8) of the Government Order giving effect to
relevant UGC guidelines, the CAS promotion shall be from
the date of completion of minimum period of eligibility.
Aggrieved by the said order of the Tribunal, the State is
before this Court in these two writ petitions.

3. Heard the learned Additional Advocate General
Sri.Reuben Jacob along with Sri.V.Shiva Reddy learned
Additional Government Advocate for petitioners-State
Authorities and Sri.Ashok Haranahalli, learned senior
counsel for Sri.Shivaraj Patil learned counsel for the
respondents. Perused the entire writ petition papers.

4. W.P.No.2527/2025 relates to benefits under
UGC Regulations, whereas, W.P.No.34390/2024 relates to
benefits arising out of AICTE Regulations.

5. Sri.Reuben Jacob, learned AAG would contend
that the Tribunal while allowing the applications of the

- 28 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

respondents failed to examine in relation to the UGC
Guidelines as well as the State Government orders in the
matter of grant of CAS. It is submitted that unless,
Selection Committee evaluates or assesses the eligibility of
the Lecturers or Associate Professors or Librarians and
recommends after the interview, no one could seek
promotion under CAS. It is further submitted that unless
the procedure prescribed under UGC guidelines is followed
and candidates are interviewed with regard to their
assessment, no one would become eligible for CAS. It is
further submitted that only on evaluation by Selection
Committee one would become eligible, as such, if the
order of the Tribunal is given effect to, it would amount to
extending benefit even before the assessment of eligibility
of the respondents. Learned AAG also contended that
when the respondents have not discharged their duties in
promoted post, they would not be entitled for higher pay.
It is submitted that the financial benefit would accrue from
the date they discharged their duties i.e., from the date of
the order dated 19.09.2022. Further, learned AAG would

- 29 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

submit that decision to grant financial benefits from the
date of the order of promotion under CAS is a policy
decision which could not have been interfered with by the
Tribunal. Learned AAG would place reliance on the
decision of the Hon'ble Apex Court in the STATE OF
HARYANA AND OTHERS v/s O.P.GUPTA reported in
(1996) 7 SCC 533 in support of his submission that a
person will not be entitled to any pay and allowances
during the period for which, he had not performed the
duty of higher post.

6. On the other hand, learned senior counsel for
respondents would submit that the CAS guideline No.8 of
the State of Karnataka makes it clear that a candidate
would become eligible for promotion on completion of
minimum eligibility period and on applying for
consideration of his case for CAS, the date of promotion
shall be from the date of eligibility. It is submitted that by
following the said guidelines, the CAS promotion was
granted to the respondents rightly under Order dated

- 30 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

19.09.2022 from the date they became eligible for
consideration of their cases under CAS.

7. Insofar as W.P.No.34390/2024 is concerned,
learned AAG advanced similar contentions as advanced
above. Further, he would submit that there is no vested
right for promotion and the promotion takes effect from
the date of order of promotion. It is also submitted that
the respondent would not be entitled for arrears as they
have not discharged the functions of promoted posts prior
to their actual promotion.

8. Having heard the learned counsel for the parties
and on perusal of the entire writ petition papers, the only
point which falls for our consideration in the facts of the
present case is, as to whether the respondent would be
entitled for promotion under CAS from the date of
promotion or from the date of completion of minimum
period of eligibility.

9. UGC Regulations of Minimum Qualification for
Appointment of Teachers and other Academic Staff in

Universities and Colleges and measures for maintenance of
Standards in Higher Education, 2010 (for short
“Regulations 2010”) and UGC Regulations of Minimum
Qualification for Appointment of Teachers and other
Academic Staff in Universities and Colleges and measures
for maintenance of Standards in Higher Education, 2018
(for short “Regulations 2018”) governs the recruitment,
appointment, promotion under CAS of the Teaching, Non-
Teaching Staff of the Universities, Colleges and
Government Colleges wherever the State Government
adopted the same. The Career Advancement Scheme
guidelines for promotion and placement of Assistant
Professors, Associate Professors, Professors, College
Librarians and College Directors of Physical
Education and Sports of Government and Private
Aided Colleges issued as per the Regulations 2018 at
Annexure-A2. Placing reliance on Guideline No.8, the
Tribunal recorded its finding at paragraph 8, which reads
as follows:
“8. The case of the respondent State for the
issue of the impugned order rests on the plea that

- 32 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

the clause 8 on which the promotions are granted
does not authorise retrospective promotions at all
and that promotions are prospective in nature. We
refer to Clause 8(i). A plain reading of the clause
states that where a candidate applies for promotion
on completion of the minimum eligibility period and
is successful in assessment, the date of promotion
shall be from that of minimum period of eligibility
(emphasis supplied). Thus while it is settled law
that promotions take effect from the date of
promotion, retrospective effect of promotion
requires to be governed by separate rule / order to
that effect. Therefore, in the present case, clause
8(i) specifically provides that the promotions shall
take effect from the date of eligibility after the
applicant – candidate is declared successful in
assessment after he has applied for promotion.
Clause 8(ii) also accords retrospective promotion
from the date of attaining eligibility in cases where
an applicant – candidate applies at a later date
presuming that he fulfills the eligibility criteria at a
later date. Thus the unmistakable conclusion is
that the State has by itself provided for
retrospective promotion from the date of attaining
eligibility although decision on promotion would be
subsequent to assessment. The reason for the said
provision is not difficult to fathom. It is that the
promotion under the CAS is not a simple exercise of
conduct of DPC regarding assessment of

Performance Assessment reports. It is assessment
by a committee and it takes time. The grant of
promotion from the date of eligibility on successful
assessment thus attributes the delay in
accordingpromotion to the process and insulates
the promotee from the administrative delays iwhich
may be inadvertent or deliberate. In the
circumstances, the contention of the learned AAG
that clause 8 supra only provides for promotions to
be prospective and not retrospective from the date
of eligibility is a misinterpretation of the Clause and
is rejected.”

10. The above guidelines for Career Advancement
Scheme issued by the State Government as per Guidelines
2018 contains Clause-8, based on which, the Tribunal held
that the CAS Promotion would come into effect the date on
which a candidate acquires minimum period of eligibility.
The said guidelines issued by the State Government is in
terms of Regulation 6.3.12 of the Regulations, 2010.
6.3.12 of Regulations, 2010 reads as follows:
“6.3.12 (a) If a candidate applies for promotion on
completion of the minimum eligibility
period and is successful, the date of

- 34 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

(b) If, however, the candidates find that
he/she fulfills the eligibility conditions at
a later date and applies on that date
and is successful, his/her promotion will
be effected from that date of application
fulfilling the criteria.

(c) If the candidate does not succeed in the
first assessment, but succeeds in the
eventual assessment, his/her promotion
will be deemed to be from the later date
of successful assessment.”

11. Clause-8 or Guideline No.8 of the State
Government with regard to Career Advancement Scheme
(Annexure-2) reads as follows:
“8.
i) If a candidate applies for promotion
on completion of the minimum
eligibility period and is successful in
assessment, the date of promotion

and applies on that date and is
successful, his/her promotion shall
be effected from the date of the
candidate fulfilling the eligibility

12. In terms of clause (10) of Regulation 5.0 of
Regulations 2018, Screening–cum-Evaluation Committee
for CAS promotion of Assistant Professors/Equivalent
Cadres in Librarians/Physical Education and Sports from
one level to the other higher level shall be constituted.
Regulation 6.3.1 of Regulations 2018 would state that a
teacher who wishes to be considered for promotion under
CAS may submit in writing to the University/College within
3 months in advance of the due date, that he/she fulfills
all the requirements under CAS and submit to the
University/College, assessment criteria and methodology
Proforma as prescribed by the University concerned
supported by all credentials as per the assessment criteria
and methodology guidelines set out in the Regulations. It
further states that in order to avoid any delay in holding
Selection Committee Meetings for various positions under
CAS, the University/College may initiate the process of
screening/selection and complete the process within 6
months from the date of receipt of applications.
Therefore, clause (8)/Guideline No.8 of the State

Government CAS promotion shall be from the date on
which a candidate completes minimum period of eligibility.
Clause (8) also provides for assigning date of promotion to
a candidate who fails to qualify in the assessment process
and in the case of such candidates, promotion shall be on
re-assessment after one year from the date of earlier
assessment.

13. Learned AAG on behalf of petitioners contended
that the promotion would be effective only from the date
of promotion and since respondents had not worked in the
promoted post they would not be entitled for any arrears
or financial benefits earlier to the date of promotion. One
has to remember that it is not a promotion to a higher
post, but it is only promotion under Career Advancement
Scheme. Under Career Advancement Scheme, a
candidate/person would become eligible to a next higher
scale on completion of minimum period of service. The
question of assuming a post or position would not arise.

- 38 -
WP No. 2527 of 2025
C/W WP No. 34390 of 2024

14. Clause 6.3.4 makes it clear that the promotion
under CAS being a personal promotion to a teacher
holding substantive sanctioned post, on his/her
superannuation, the said post reverts back to its original
cadre. Therefore, the question whether promotion would
be prospective or retrospective would not arise. The CAS
promotion, therefore, is made to be effective on
completion of minimum qualifying service.

15. Insofar as W.P.No.34390/2024 is concerned,
the benefit of re-designation/promotion to the post of
Assistant Professor is rightly given from the date of the
respondents therein acquiring Ph.D Degree in the year
2014 i.e., on 25.09.2014. It is noticed that the
respondent therein had qualified in all respects and
Evaluation Committee had assessed him to be eligible for
grant of re-designation or promotion to the post of
Associate Professor from 25.09.2014. The minimum
qualification for promotion was Ph.D Degree and
completion of 3 years of service in the cadre below. The
petitioner was rightly granted re-designation/promotion to

the post of Assistant Professor on acquiring minimum
qualification or on acquiring qualification i.e., acquiring
Ph.D., degree and on completion of three years service as
Assistant Professor.

16. Notification dated 08.11.2012 issued by AICTE
in exercise of its power under AICTE (Career Advancement
Scheme for the Teachers and Other Academic Staff in
Technical Institutions) (Degree) Regulations, 2012 (for
short, ‘Regulations’) prescribes criteria/condition to be
fulfilled for entitlement to Career Advancement. The
criteria or condition that are similar or identical to that are
prescribed under UGC Regulations for Career
Advancement. Regulation 2.1, 2.2, 2.10, 2.14 and 2.15 of
the Regulations reads as follows:
“2.1 A teacher who wishes to be considered
for promotion under CAS may submit in writing to
the University/College, within three months in
advance of the due date, that he/she fulfils all
qualifications under CAS and submit to the
University/College the performance Based Appraisal
System (PBAS) in a proforma as evolved by the
concerned University/College duly supported by all
credentials as per the Academic Performance

Indicator (API) guidelines (Appendix 1) se tout in
these Regulations.

2.2 In order to avoid delays in holding
Selection Committee meetings in various positions
under CAS, the University/College should
immediately initiate the process of
screening/selection, and shall complete the process
within six months from the date of application.
Further, in order to avoid any hardships, candidates
who fulfil all other criteria mentioned in these
th
Regulations, as on 05 March, 2010 and till the
date on which these Regulations is notified, can be
considered for promotion from the date, on or after
th
5 March, 2010, on which they fulfil the eligibility
conditions.

2.10 CAS promotion, being a personal
promotion to the incumbent teacher holding a
substantive sanctioned post, on superannuation of
the individual incumbent, the said post shall revert
to its original cadre.

2.14 If a candidate applies for promotion
immediately on completion of the minimum
eligibility period and is successful, the date of
promotion will be made applicable from the date of
completion of minimum period of eligibility.

2.15. If, however, the candidate finds that
he/she fulfils the eligibility conditions at a later date

and applies on that date and is successful, his/her
promotion will be effected from the date of
application.”

17. In the instant case, the petitioner is Assistant
Professor seeking Career Advancement on completion of
minimum period of service on completion of Ph.D. The
relevant Regulation 3.8 insofar as Assistant Professors are
concerned reads as follows:
“3.8 Assistant Professor completing three
years of teaching in the grade of Rs.8000 (stage 3)
shall be eligible, subject to the qualifying conditions
and the API based PBAS requirements prescribed
by these Regulations, to move to the Pay Band of
Rs.37400-67000 with next higher grade of Rs.9000
(stage 4) and to be designated as Associate
Professor. However those joining the Service after
th
5 March 2010 shall have also earned PH.D in
addition to above mentioned requirements to move
to the stage 4.”

18. Apart from above provisions, Regulation 2.6
provides for constituting Screening-cum-Evaluation
committee for CAs promotion. Regulation 2.14 makes it
abundantly clear that if a candidate applies for promotion
immediately on completion of the minimum eligibility

period as well as minimum eligibility criteria and is
successful, the date of promotion would be made
applicable from the date of completion of minimum period
of eligibility. Government order dated 08.12.2020
(Annexure-A10) prescribes or lays down the criteria or
conditions for CAS in pursuance to Regulations. Clause (5)
of the said Government order reads as follows:

The above clause also makes it clear that teaching staff
would be entitled for CAS from the date of acquiring
qualification and not earlier to that. In terms of the
Regulations and the above Government order, the Tribunal
is justified in coming to the conclusion that the respondent
would be entitled for the re-designation as Associate
Professor from 25.09.2014 the date on which he acquired
Ph.D., Degree.

19. For the reasons recorded above, we are of the
considered opinion that there is no merit in the writ
petitions and accordingly, both the writ petitions stand
dismissed.
