said purpose, he has been maintaining current accounts with the sixth

respondent in W.P.(Crl).No.2714 of 2026 and the seventh respondent in WP.
(Crl).No.2700 of 2026.
2. The petitioner claims that a sum of Rs.48,581/-was the subject matter
of dispute for which lien had been created over his bank account by the seventh
respondent in W.P.Crl.No.2700 of 2026. Similarly, he states that lien had been
created by the sixth respondent in W.P.Crl.No.2714 of 2026. The amount
involved in W.P.No.2714 of 2026 is Rs.17,979/-. As the entire accounts had
been frozen, despite the best efforts of the petitioner, as no action had been
initiated, he is before this Court.
3. I called upon Mr.S.Yogaraja Sekar to take notice and get instructions
from the official respondents. I had further directed the Commissioner of Police,
Coimbatore, to serve notice on the seventh respondent in W.P.(Crl.).No.2700 of
2026 and on the sixth respondent in W.P(Crl.).No.2714 of 2026.
4. Despite service of notice, no one represents the seventh respondent in
W.P.(Crl.).No.2700 of 2026 and the sixth respondent in W.P(Crl.).No.2714 of
2026.
5. The debit freeze has been created by the seventh respondent on
23.04.2026 and by the sixth respondent on 12.03.2026.

6. Taking into consideration that disputes regularly arise on account of
such orders of debit freeze, the Supreme Court had called upon the National
Cyber Crime Reporting Portal to evolve an SOP to resolve the disputes.
National Cyber Crime Reporting Portal had also evolved an SOP. It directs the
banks and the police officials to keep the debit freeze order alive for 90 days
and on the expiry of the said period, left it open to the banks to de-freeze the
account, if no further orders had been issued by the law enforcing agency or by
the court.
7. A perusal of the papers indicate that the account had been frozen in the
first writ petition on 23.04.2026 and in the second writ petition on 12.03.2026.
More than 7 months have elapsed and no further intimation had been given as
regards the further orders to be passed. Keeping the debit freeze lien beyond the
period prescribed by the National Cyber Crime Reporting Portal cannot be
considered as legal.
8. Apart from that, the amount involved in W.P(Crl.).No.2700 of 2026 is
Rs.48,581/- and the amount involved in W.P(Crl.).No.2714 of 2026 is
Rs.17,979/-. When there is an excess of amount in the respective accounts more
than that involved in the debit freeze order, the banks ought to have permitted

the operation of the accounts, retaining the lien to the extent of the amount
involved in the debit freeze orders. Unfortunately, it has not been done so.
9. Hence, these writ petitions are ordered in the following terms:
(i) The seventh respondent in W.P.No.2700 of 2026 and the sixth
respondent in W.P.No.2714 of 2026 shall retain the lien for a sum of
Rs.48,581/- and Rs.17,979/- respectively. They shall defreeze the accounts and
permit the petitioner to operate the same, insofar as the balance is concerned.
This action shall be done forthwith.
(ii) The aforesaid banks shall get in touch with the authorities who had
imposed the debit freeze orders and wait for a period of two weeks. If there is
no fresh intimation from the law enforcing agency as regards any new orders
with respect to the debit freeze, they shall permit the petitioner to operate the
accounts without any lien.
(iii) The first clause of this paragraph shall come into force immediately.
The second clause of this paragraph will come into force within a period of two
weeks from the date the respondent banks contact the law enforcing agency.
