CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR
ORAL JUDGMENT
Date : 01-09-2026
Patna High Court CWJC No.3802 of 2026 dt.01-09-2026
4/10
Heard Mr. Y.V. Giri, learned Senior Advocate duly
assisted by Mr. Sanjeev Kumar, learned Advocate for the
petitioners and Mr. Prabhakar Jha, learned Government Pleader
No.27 assisted by Mr. Mukund Mohan Jha, learned Advocate
for the State.
2. The grievance of the petitioners, is in a narrow
compass. It is contended that the action of the respondents in
issuing the order of posting vide Memo No. 46 dated
14.01.2026, under the signature of the Director, (Primary)
Education, whereby the petitioners have been posted at different
places of posting, is contrary to the mandatory provisions
relating to allocation/posting on the basis of merit-cum-choice
and also runs contrary to the roster clearance stipulated in
Advertisement No. 26/2024 issued by the Education
Department, Government of Bihar.
3. The further grievance as has been raised in the writ
petition is that, notwithstanding the order passed by this Court
in CWJC No. 11252 of 2025, whereby the concerned authorities
were directed to reconsider the manner of allocation of districts
to the remaining candidates, the respondents have once again
resorted to a process which has resulted in the petitioners being
displaced to far-flung districts, leaving them with no viable option for
Patna High Court CWJC No.3802 of 2026 dt.01-09-2026
5/10
securing a posting in or near their home districts.
4. Mr. Y. V. Giri, learned Senior Advocate appearing
for the petitioners, drawing the attention of this Court to the
judgment dated 30.08.2025 passed in CWJC No. 11252 of 2025,
submits that, in paragraphs 45, 46, 47, 48 and 49 of the said
judgment, this Court had issued specific directions to the effect
that the Committee entrusted with the task of allocation of
preferential districts was required to invite objections from the
candidates and consider the same manually, after taking into
account their home district, the reasons for seeking posting in a
nearby district, the availability of vacancies in the concerned
district/block, and their corresponding merit position. Pursuant
thereto, the authorities have passed a subsequent order dated
20.08.2026, wherein the Committee, in its meeting held on the
same date, decided that, in respect of 914 Headmaster
candidates who had earlier been allotted divisions/districts on
the basis of randomisation, their posting/allocation of
division/district would now be undertaken manually in the
nearest possible division/district, on the basis of the choices
furnished earlier, keeping in view their home district and the
availability of seats, as reflected in the relevant records, and
following the principle of merit-cum-choice. It is argued that,
Patna High Court CWJC No.3802 of 2026 dt.01-09-2026
6/10
once this Court had made it clear that no further randomisation
was permissible, the authorities, under the guise of making a
manual allocation, have again proceeded to allocate postings in
a manner substantially based upon randomisation. According to
the petitioners, such action amounts to a deliberate disregard of
the specific directions issued by this Court and is, therefore,
contended to be in the teeth of the order passed in CWJC No.
11252 of 2025.
5. Mr. Giri, further contended that, irrespective of the
decision taken by the Government to post the selected
Headmasters not only in Utkramit/Newly Established Higher
Secondary Schools but also in Rajkiya, Rajkrit and Project
Kanya Uchch Madhyamik Vidyalayas, the actual exercise of
posting has, in all the cases, been confined only to Utkramit and
Newly Established Higher Secondary Schools. It is, therefore,
submitted that the respondents have failed to give effect to the
policy/decision of the Government in its true letter and spirit,
thereby adversely affecting the legitimate claim of the
petitioners for posting in accordance with the prescribed criteria.
6. In response to the aforesaid facts, the justification
advanced by the concerned respondents that, in terms of Rule
20(4) of the Rules, 2021, the posts in question are required to be
Patna High Court CWJC No.3802 of 2026 dt.01-09-2026
7/10
identified for being filled up by way of promotion as well as
direct appointment, is wholly arbitrary and discriminatory.
7. On the other hand, Mr. Prabhakar Jha, learned
Advocate appearing for the State, referring to the supplementary
counter affidavit filed on behalf of respondent no. 3, submitted
that, pursuant to the last order dated 28.07.2026, the Committee,
in its meeting held on 20.08.2026, took a considered decision to
ensure due compliance with the judgment passed in C.W.J.C.
No. 11252 of 2025. The following decisions were accordingly
taken:

8. Referring thereto, Mr. Jha, further submitted that, in
respect of altogether 914 Headmasters who had been allotted
divisions/districts on the basis of randomization, their posting in
the division/district shall now be undertaken manually, in the
nearest possible division/district, on the basis of the choices
furnished by them earlier, keeping in view their home district
and subject to the availability of vacancies/seats in their
respective categories, on the basis of merit-cum-choice.
9. Having considered the submissions advanced on
behalf of the respective parties, the averments made in the
affidavits, as well as the undertaking furnished before this Court
that the posting of the petitioners shall be made manually in the
nearest possible division/district, on the basis of the choices
furnished by them earlier in their respective categories and in
accordance with the principle of merit-cum-choice, this Court is
of the opinion that, at this stage, no further adjudication is
required.
10. Accordingly, the aforesaid exercise shall be
completed, preferably, within a period of twelve weeks from
today.
11. It is, however, made clear that neither the order
passed by this Court nor the consequential posting order issued
Patna High Court CWJC No.3802 of 2026 dt.01-09-2026
10/10
in favour of the petitioners shall preclude or prejudice their right
to approach the authorities concerned, in accordance with law,
for redressal of any grievance which may still survive for any
other reason.
12. With the aforesaid observations and directions,
this Court does not find any reason to keep the present writ
petition pending. Accordingly, the same stands disposed of.
