1. This writ petition is filed on behalf of the Petitioner under Article 226
of the Constitution of India laying a challenge to Transfer Order dated
15.09.2026, whereby he has been transferred from DIG Range, Silchar to
JKZ Headquarters as also to the consequential Signal dated 05.10.2026, to
the extent it concerns the Petitioner.
2. Petitioner joined CRPF as an Assistant Commandant on 29.02.1996
and was promoted to the rank of Commandant on 28.10.2014. After

rendering over 30 years of service, Petitioner is due to superannuate on
30.11.2029. The impugned transfer order is challenged by the Petitioner on
twofold grounds. Arguing on behalf of the Petitioner, learned counsel
submits that if the Petitioner is transferred to JKZ Headquarters at this stage
he will be deprived of completing his Mandatory Field Service (MFS) for
the purpose of promotion. Petitioner preferred a representation to the
Competent Authority pointing out that he has not completed the MFS, which
may impact his next promotion and requesting for suitable posting as also
bringing forth that one vacancy has recently arisen in the post of
Commandant, 156 BN, CRPF against which the Petitioner can be
accommodated, but to no avail.
3. Alternatively, it is urged that Petitioner has been continuously serving
in North East since 08.06.2021 and has spent over five consecutive years in
the region in addition to earlier North East postings. Petitioner is
approaching superannuation and has family responsibilities such as
marriages of his children as also construction of residential house in his
hometown in Kochas, District Rohtas, Bihar and therefore, in his
representation he requested for terminal posting at a suitable unit or
establishment in Bihar or Jharkhand so that he could devote time to his
family responsibilities and equally perform the official duties. It is submitted
that paragraph 3(C) of Standing Order-05/2022 dated 27.09.2022 provides
for terminal posting in the last leg of the tenure of an officer, subject of
course to available vacancies and administrative and operational
requirements, however, no heed has been given even to this request.
4. Learned counsel appearing for the Respondent, on instructions, from
the officers present in Court submits that the argument of the Petitioner that

he will not be able to complete MFS if he is transferred to JKZ Headquarters
is misplaced inasmuch as his posting tenure at RTC-AVD/HQ from
24.08.2015 to 07.06.2021, being a training centre will be counted towards
MFS requirement and therefore, this requisite criteria for next promotion
stands satisfied. As for the request for terminal posting at Petitioner’s
hometown, it is submitted that Petitioner has no right to seek posting of his
choice and every clause in the transfer policy including paragraph 3(C) of
Standing Order-05/2022 is subject to service exigencies and administrative
and operational requirements of the Force. Be that as it may, it is candidly
submitted that Respondent has no objection for reconsidering the request of
the Petitioner for posting at his hometown as he is due to superannuate on
30.11.2029.
5. In light of the stand of the Respondent that Petitioner’s tenure at RTC-
AVD/HQ from 24.08.2015 to 07.06.2021 will be counted as MFS for next
promotion of the Petitioner, this ground of challenge is not tenable. The
stand of the Respondent in this regard is taken on record and shall bind the
Respondent. Admittedly, Petitioner is due to superannuate on 30.11.2029
and the present posting may be his terminal posting. While it cannot be
disputed that member of the Force cannot assert a right to be posted at any
particular place of his choice as postings are regulated by service exigency
and operational requirements and similar is the position with any policy of
transfer. However, Petitioner has made a representation bringing forth
family circumstances including construction of a house, which require him
to be near his hometown. Paragraph 3(C) of the Standing Order-05/2022
permits terminal posting of an officer at the fag end of his career and while
Petitioner may not have a right to be posted at the place he chooses, but he

certainly has a right of consideration of his representation which is based on
a Standing Order.
6. Accordingly, without entering into the merits of the claim of the
Petitioner for terminal posting to or around his hometown in terms of
paragraph 3(C) of Standing Order-05/2022, this petition is disposed of with
a direction to the Respondent to consider the case of the Petitioner for
posting to his hometown as a last leg posting and take a decision within
three weeks from the date of receipt of copy of this order. The decision will
be communicated to the Petitioner, who will be at liberty to take recourse to
legal remedies, if aggrieved.
7. Writ petition is disposed of along with pending application in the
aforesaid terms.
