ex-serviceman who, after his retirement from the Army, established an ice

factory in his village and obtained an electricity connection for seasonal
consumption from the respondents. It is submitted that, due to certain
circumstances, the factory could not remain operational and the petitioner
had also submitted an application dated 25.07.2019, informing the
respondents about the closure of the factory and requesting them to take
necessary steps in respect of the electricity connection and billing. Learned
counsel for the petitioner further submits that, during the COVID-19
pandemic, the outstanding electricity dues increased substantially and
reached approximately Rs.27 lakhs. The petitioner approached the
respondents for adjustment of the outstanding amount under the Samadhan
Yojana and, pursuant to the settlement, deposited approximately Rs.21 lakhs
with the respondents. It is contended that despite the substantial amount
already deposited by the petitioner, the respondents again raised an
electricity bill for the month of May, 2026, amounting to Rs.19,11,896/-
along with surcharge. It is further submitted that the petitioner thereafter
approached the respondents seeking the benefit of the departmental Maafi
Yojana for adjustment of the outstanding electricity dues. The respondents
issued a communication dated 08.04.2026 (Annexure P/1), but no final
decision has been taken on the petitioner's grievance so far. Learned counsel
submits that, without considering the petitioner's grievance and without
affording him an opportunity of hearing, the respondents disconnected the
electricity connection in September, 2026. Learned counsel for the petitioner
submits that the petitioner has already deposited a substantial amount

towards the electricity dues and has repeatedly approached the respondents

for adjustment of the outstanding amount in accordance with the applicable
scheme. However, his representation has not been considered in its proper
perspective. It is also contended that similarly situated consumers have been
extended the benefit of the Samadhan/Maafi Yojana, whereas the petitioner's
case has not been considered, resulting in discriminatory treatment. Learned
counsel for the petitioner, therefore, submits that the respondents be directed
to consider the petitioner's case in the light of the communication dated
08.04.2026 (Annexure P/1) and take an appropriate decision regarding
adjustment of the outstanding electricity dues under the applicable scheme. It
is further prayed that the respondents be directed to consider the petitioner's
grievance regarding disconnection of the electricity supply.
3. At this stage Shri Rinkesh Goyal, learned counsel takes notice on
behalf of the respondents.
4. Considering the submissions made by learned counsel for the
petitioner and the nature of the relief sought in the present petition, this Court
is of the view that the ends of justice would be met by directing the
competent authority to consider the petitioner's grievance.
5. Accordingly, without expressing any opinion on the merits of the
case, the present petition is disposed of with a direction to respondent No.3
to consider the case of the petitioner in the light of the communication dated
08.04.2026 (Annexure P/1) and pass an appropriate order, in accordance
with law, within a period of two weeks from the date of receipt of a certified
copy of this order.
