CORAM: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL

ORAL ORDER
This writ petition is filed seeking the following prayer:
I. “Issue a Writ in the nature of the certiorari
thereby quashing the impugned final selection
list dated 29.05,2026 passed by the recruitment
of Selection Committee, Bidar vide Annexure-W,
in the interest of justice and equity.

II. Issue Writ in the nature of Mandamus thereby
directing the respondent authorities to appoint
petitioner as Anganwadi Helper in Humnabad,
Tq. Humnabad, Dist. Bidar in place of
respondent No.5 by allowing the present Writ
Petition, in the interest of justice and equity.

III. Issue any other suitable Writ or order or
direction which the Hon'ble Court may deems fit
in the circumstances of the case, as stated
above, in the interest of justice and equity.”

2. Sri.Manvendra Reddy, learned counsel
appearing for the petitioner submits that the petitioner as
well as the respondent No.5 have applied to the post of
Anganwadi worker at Humnabad pursuant to the

notification at Annexure-A. It is submitted that the
respondent No.5 is not a resident of Humnabad town. She
was married off to Humnabad and her residence is at
Byalahalli of Bhalki Taluk. It is further submitted that only
for the purpose of obtaining the job, the respondent No.5
produced an incorrect residence certificate and got
selected in the process. It is also submitted that the
petitioner has objected to the selection of the respondent
No.5. However, the Authorities proceeded to select
respondent No.5 as an Anganwadi worker at Humnabad.
It is contended that the jurisdictional Tahsildar, based on
the complaint of the petitioner, conducted an enquiry. The
enquiry revealed that the respondent No.5 is married and
is a permanent resident of Byalahalli of Bhalki Taluk and
temporarily she is residing in Humnabad. Hence, her
appointment is required to be set aside. It is further
contended that the respondent No.5 had not disclosed her
husband's name in the application and in all the records,
she has referred to her father's name. Hence, he seeks to

allow the petition by setting aside the appointment of the
respondent No.5 as an Anganwadi worker.

3. Per contra , the learned Additional Government
Advocate appearing for the respondent Nos.1 to 4 and
Sri.B.Bhimashankar, learned counsel appearing for the
respondent No.5 support the selection and submit that the
respondent No.5 is a resident of Humnabad, as is evident
from the residence certificate produced and considering
the same and taking note of the comparative merits of the
petitioner and the respondent No.5, the Authorities found
that the respondent No.5 is more meritorious than the
petitioner and have appointed the respondent No.5 as an
Anganwadi worker, which does not call for any
interference. Hence, they seek to dismiss the petition.

4. I have heard the arguments of the learned
counsel appearing for the petitioner, the learned Additional
Government Advocate appearing for the respondent Nos.1
to 4, the learned counsel appearing for the respondent

No.5 and meticulously perused the material available on
record.

5. The respondent No.3 invited applications vide
notification dated 19.01.2024 to fill up the posts of
Anganwadi workers at various places including Humnabad.
The petitioner as well as the respondent No.5 filed
applications seeking appointment as Anganwadi workers at
Humnabad. Both have produced the residence certificate
issued by the competent authority. By considering the
same and taking note of the comparative merits, the
Authorities proceeded to select the respondent No.5 as the
Anganwadi worker at Humnabad. The petitioner
submitted a complaint / objection vide communication
dated 11.03.2025 at Annexure-F indicating that the
respondent No.5 was temporarily residing at Humnabad.
Her residence is at Byalahalli, Bhalki Taluk. The Tahsildar
conducted an enquiry and based on the report of the
Revenue Inspector, is of the opinion that the respondent

No.5, around 7 years ago, used to reside at Byalahalli
Village of Bhalki Taluk and now she is residing at
Humnabad.

6. Be that as it may, the notification dated
19.01.2024 makes it clear that a candidate who intends to
seek an appointment as an Anganwadi worker, is required
to produce the residence certificate of the place where the
said post is being filled. In the case on hand, admittedly,
the petitioner as well as the respondent No.5 have
produced the certificate of residence issued by the
jurisdictional Tahsildar and the said certificate, insofar as
the respondent No.5 is concerned, is neither challenged
nor cancelled. Hence, the other contentions urged by the
petitioner has no merit.

7. The respondent Nos.2 to 4, considering various
aspects have decided that the respondent No.5 is more
meritorious than the petitioner and have proceeded to

appoint respondent No.5 as an Anganwadi worker at
Humnabad. The same does not call for any interference.

8. The contention of the learned counsel for the
petitioner that the voter list and election ID of the
respondent No.5 indicates that she is a resident of
Byalahalli Village, Bhalki Taluk, has no merit as the
jurisdictional Tahsildar has issued a valid residence
certificate in favour of the respondent No.5 which has
been accepted by the Authorities and until the said
certificate is annulled or cancelled, the said contention
urged by the petitioner has no merit.

9. The further contention of the petitioner that the
respondent No.5 has failed to disclose that she is married
and has continued to show her father's name in all the
records, also has no merit because there is no such
requirement in the notification.

view that the writ petition is devoid of merit and is liable
to be rejected. Hence, I proceed to pass the following:

hereby rejected .
