promote the petitioner to the post of Executive Engineering with effect
from 05.12.2016 i.e., the date on which the co-employees of the
petitioner were given promotion as Executive Engineering based on the
notification in Na.Ka.No.Pa.Ku.1/2014 dated 07.12.2015 of the second
respondent.

PRAYER: S-4. To issue a Writ of Mandamus or any other appropriate
writ or order or direction in the nature of the writ to direct the 4th
respondent to promote the petitioner to the post of Executive Engineer in
terms of the Byelaw of the society in the light of the proceedings issued
by the 1st respondent vide his proceedings Na.Ka.No.14029/N2/2017 dt
23.09.2017 and by considering the petitioner representation dt
09.11.2020.

COMMON ORDER
These two writ petitions have been filed by the same petitioner
asking for the relief of promotion.
2.Mr.R.V.Rajkumar, learned counsel for the petitioner would
submit that the petitioner joined the services of the second respondent as
a Casual Labourer on 01.09.1993 and was regularised with effect from
12.03.2001, vide proceedings dated 19.10.2007. The petitioner had
acquired the qualifications of Diploma in Mechanical Engineering in
1999 and Bachelor of Engineering (Mechanical) in 2009 and also had
completed the course of Boiler Attendant (II class), for which he was
issued with the National Trade Certificate under the Boilers Act, 2025.
3.He would further submit that the petitioner was later promoted to
the post of Technician on 12.01.2013 and when the second respondent
invited applications for filling up the vacancies in the post of Executive
Engineer among eligible candidates, the petitioner had applied and was as
well shortlisted. However, no interview or any other selection was
conducted, but promotion order was issued in favour of only 22
employees, leaving out the petitioner. Aggrieved against his non
consideration, the petitioner had filed these two writ petitions.

4.Today, when the matter was taken up, Mr.J.Devasenan, learned
counsel for the respondents 1 to 4 submitted that the petitioner had given
a representation on 22.10.2026, making a request for promotion to the
post of Executive Engineer with effect from 01.01.2023 with all attendant
monetary benefits and that the second respondent is willing to consider
the said request in a positive manner.
5.Recording the submission of Mr.J.Devasenan, learned counsel
for the respondents 1 to 4, this Writ Petition is disposed of with a
direction to the second respondent to pass orders on the representation
given by the petitioner dated 22.10.2026 within a period of four weeks
from the date of receipt of a copy of this order as was undertaken before
this Court that it will be considered positively. No costs. Consequently,
connected Miscellaneous Petitions are closed.
