ORDER
The prayer in this Writ Petition is for a Mandamus directing the
respondent Nos.6 and 8 to consider the representation of the petitioner,
dated 01.05.2026 and consequently, to direct the respondent Nos.6 and 8 to
de-freeze all the accounts of the petitioner mentioned in paragraph No.11
of the affidavit as well as the annexure to the typed set of papers.
2. Learned Counsel for the petitioner would submit that the
petitioner has resigned from the M/s.Amaze Properties India Limited in the
year 2021 itself. He has got nothing to do with the crime. Apart from the
personal accounts of the petitioner, even the loan accounts and the
accounts, in which, the petitioner was a partner prior to the registration of
the FIR, are all now freezed. Particularly, one account of SR Builder and
Developers has huge money, in which, the petitioner has even resigned
from the partnership even in the year 2021. The other partners are not the

accused and the money is not proceeds of the crime. A perusal of the
statement of accounts itself would reveal that it was a contract amount
received from TN Cricket Association towards the construction work
carried out by them. Therefore, they must be permitted to operate all the
accounts.
3. Per contra , learned Additional Public Prosecutor would
oppose the prayer by submitting that the petitioner is very much an
accused under the provisions of the TNPID Act. Both the proceeds of the
crime and also the properties of the accused are liable for attachment.
Accordingly, the bank accounts are freezed. With reference to the jewel
account, it has to be seen as to whether the jewels were brought out of the
proceeds of the crime. With reference to the loan accounts, even though
the same were freezed, the prosecution has no objection for the same to be
de-freezed. With reference to the other accounts, the money is liable to
come to the account of the competent authority to enable the same to be
distributed among the victims. He would submit that when the petitioner
is very much in control over of all the businesses, only because to escape
from liability, the documents are created as if the petitioner has retired
from partnership and others are continuing as partners. The truth or

otherwise of the same will come out only during the further investigation
which is being carried on in the instant case and it will be subject to trial.
4. I have considered the rival submissions made on either side
and perused the material records of the case.

6. With reference to the above bank accounts, since the learned
Additional Public Prosecutor has no objection, let the Investigating
Officer/competent authority send communication to the concerned banks
de-freezing the said accounts and accordingly, the same will stand de-
freezed.

7. With reference to account in account No.50200052806859, in
HDFC Bank, Thillai Nagar, Trichy, in the name of I.Selvaraj, the
petitioner will be permitted to operate the loan account to the extent to
redeem the jewel. However, the jewel will not be handed over until the
investigation is complete and the Investigating Authority says no
objection. With reference to the other personal as well as the partnership
accounts, in which, the petitioner's name is still there or he has come out of
the partnership etc., since everything has to be investigated and it has to be
ultimately found out whether the money is belonging to the accused or
other, whatever the amount that is existent as on date, shall remain debit
freezed and shall not be paid out to the accused or any person operating the
account.
8. Otherwise, the following bank accounts shall be permitted to
be operated subject to the condition that the amount lying to the credit of
the account, as on date of the freezing, shall not be permitted to be
withdrawn:-
