ORAL ORDER
This writ petition is filed seeking following prayers:
“a) Issue a writ certiorari quashing the notification of
recruitment as per Annexure-B bearing no.
¸ÀA.G¤¯Á/ªÀĪÀÄ/CA.PÉÃ/DPÁPÀ.CA.¸ÀºÁ/SÁ.ºÀÄ.¥Àæ/2025-26 dated
08.12.2025 to the extend of recruitment for the post
of Anganwadi Assistant pertaining to Anganwadi
Center Madarakal-03 under Palakanamaradi Gram
Panchayat Taluk Devadurga Dist. Raichur. passed by
respondent no.5;
b) Mandamus by directing the respondents to
consider representation of the petitioner dated:
20/12/2025 and 26/12/2025 as per Annexure-E and
E1 for the promotion to the vacant post Anganwadi
Assistant at Anganwadi Center Madarkal-03, Taluk
Devadurga Dist. Raichur as per G.O
ªÀĪÀÄE 154 L¹r
dated 03.12.2022 vide Annexure-D and
2020 ¨ÉAUÀ¼ÀÆgÀÄ
grant her promotion as per law;

c) Issue any other order or direction as deemed fit
by this Honourable Court under the facts and
circumstances of the case”
2. Sri J. Augustine, learned counsel for the
petitioner submits that petitioner is working as an
Anganwadi Assistant in Madarkal Anganwadi Centre No.2
at Devadurgh Taluk of Raichur district. She submitted
representation seeking to promote her as an Anganvadi
worker, on the ground that there is a vacancy of
Anganwadi worker. However, the authorities have issued a
notification dated 08.12.2025 inviting application to fill up
the post of Anganwadi worker. It is submitted that as per
the Government Order dated 03.12.2022, a procedure for
appointment and promotion has been contemplated and
the present notification issued is contrary to the said
Government Order. Hence, he seeks to allow the petition
by setting aside the impugned notification dated
08.12.2025 by directing the respondents to promote the
petitioner as an Anganwadi worker.

3. Per contra , learned High Court Government
Pleader appearing for the respondent Nos. 1, 2 and 4 to 6
and Sri. Gourish S. Kashampur, learned counsel appearing
for the respondent Nos.3 supports the impugned
notification and submits that the petitioner is working as
an Anganwadi Assistant in Madarkal Anganwadi Centre
No.2 and there is no vacancy for promotion there. It is
further submitted that the invitation for filling up the post
is for Madarkal Anganwadi Centre No.3 and said post is
reserved for Scheduled Tribes. Hence, the petitioner has
no case and seeks to dismiss the petition.
4. I have heard the arguments of learned counsel
for the petitioner, learned High Court Government Pleader
and learned counsel appearing for the respondent No.6
and meticulously perused the material available on record.
5. It is not in dispute that the petitioner is working
as an Anganwadi Assistant at Madarkal Anganvadi Centre
No.2 of Devadurgh Taluk, Raichur District from last 8

years. The grievance of the petitioner is that the petitioner
is entitled to be promoted as an Anganwadi worker as per
Government Order dated 03.12.2022 at Annexure-D, more
particularly by referring to clause 6 that the petitioner is
entitled to be promoted as an Anganwadi Worker, as she
is working as an Anganwadi Assistant. It is to be noticed at
the outset that the notification inviting applications to the
post of Anganwadi worker at Annexure-B is for the
Madarkal Anganwadi Centre No.3 and not where the
petitioner is working. A perusal of the Government Order
at Annexure-D indicates that if any vacancy arose in a
centre, where Anganwadi Assistant is working, then a
preference is provided to such a candidate to seek for
promotion as an Anganwadi worker. In the case on hand,
there is no vacancy of Anganwadi worker in Madarkal
Anganwadi Centre No.2. Hence, the petitioner cannot seek
for promotion in another Anganwadi Centre. Admittedly, in
Madarkal there are 4 Anganwadi Centers as per the

submission of the learned counsel appearing for the
respondents.
6. Be that as it may, the issuance of notification
for inviting an application to appoint Anganwadi worker is
at Madarkal Anganwadi Centre No.3 and the said post is
admittedly reserved for the candidate belonging to the
Scheduled Tribes. Hence, I am of the considered view that
the petitioner cannot seek promotion in some other
Anganwadi Centre, which is not available as per the
Government Order dated 03.12.2022 at Annexure-D.
7. The writ petition is devoid of merit and the
same is rejected . Accordingly, I.A.No.2/2026 for
impleading proposed respondent No.7 stands rejected.
