In brief

The question

Whether the appellants’ convictions required reconsideration when they expressly confined the appeal to sentence.

The court held

The Court maintained the convictions but modified the sentences by reducing the substantive imprisonment to the period already undergone and enhancing the fine from Rs. 500 to Rs. 2,000 for each appellant.

It also directed

The enhanced fine was to be deposited within two months and, upon deposit, paid to the complainant as compensation under Section 357 CrPC; on default, the appellants were to undergo the sentence imposed by the trial court.

The appellants’ bail bonds were discharged, and the appeal was disposed of with that modification.

01Facts

The appellants were convicted by the Special Judge (SC/ST Act), Guna, of offences under Sections 325/34, 323/34 and 341 of the Indian Penal Code, 1860, and sentenced to imprisonment and fines.

¶ 1

The prosecution arose from a 2004 dispute over agricultural land, during which the appellants allegedly assaulted the complainant’s relatives.

¶ 3

In their appeal under Section 374(2) of the Code of Criminal Procedure, 1973, the appellants did not challenge the convictions and sought only reduction of sentence.

¶ 1–2

They relied on the time elapsed, periods already spent in custody, Gopal’s age, absence of criminal antecedents and their conduct while on bail; they also stated that the trial court’s fines had been paid.

¶ 5

02Issues

i.Whether the appellants’ convictions required reconsideration when they expressly confined the appeal to sentence.

¶ 2

ii.Whether the substantive sentences should be reduced to the periods already undergone, with an enhancement of fine, having regard to the circumstances relied upon by the appellants.

¶ 5–9

03Law Applied

The appeal was brought under Section 374(2) of the Code of Criminal Procedure, 1973, against convictions under Sections 325/34, 323/34 and 341 of the Indian Penal Code, 1860.

¶ 1

The Court also directed that the enhanced fine be paid to the complainant as compensation under Section 357 of the Code of Criminal Procedure.

¶ 9

In deciding sentence, the Court considered the case-specific circumstances, including the time elapsed, custody already undergone, age, criminal antecedents and conduct of the appellants.

04Reasoning

Since the appellants did not contest their convictions, the Court considered only the appropriate sentence.

¶ 2

It noted that the incident had occurred in 2004 and the appellants had faced criminal proceedings for almost 22 years; it also considered their periods in custody, their lack of recorded criminal antecedents and satisfactory conduct during incarceration, including Gopal’s age of 71.

¶ 5, 8

In those circumstances, the Court found that reducing imprisonment to the period already undergone would serve the ends of justice, while enhancing the fine would balance the equities.

¶ 8–9

05Holding

The Court maintained the convictions but modified the sentences by reducing the substantive imprisonment to the period already undergone and enhancing the fine from Rs. 500 to Rs. 2,000 for each appellant.

¶ 8–9

The enhanced fine was to be deposited within two months and, upon deposit, paid to the complainant as compensation under Section 357 CrPC; on default, the appellants were to undergo the sentence imposed by the trial court.

¶ 9

The appellants’ bail bonds were discharged, and the appeal was disposed of with that modification.
