Belated service-promotion claims omitted from earlier proceedings are barred by constructive res judicata.

The applicant, a former Junior Clerk in Southern Railway, claimed that he should have received promotions following railway cadre restructuring, ultimately to Chief Office Superintendent from 20 January 2013.

He alleged that he had been denied promotion while juniors advanced, despite having passed the Ministerial Staff Training Course (MSTC).

The respondents maintained that promotion required passing a suitability test, which the applicant failed in 2014 and did not attend when called again in 2016.

The Tribunal also noted that, in earlier proceedings, the applicant had obtained directions concerning ACP benefits and that his pay had been refixed with second ACP and third MACP benefits.

Whether the applicant’s claim to retrospective promotion was barred by constructive res judicata because it could and should have been raised in his earlier proceedings.

Whether the promotion claim was time-barred, or could be treated as a continuing cause of action.

Whether the applicant was entitled to promotion without passing the prescribed suitability test, having passed MSTC.

Explanation IV to Section 11 of the Code of Civil Procedure deems a matter that might and ought to have been raised as a ground of attack in earlier proceedings to have been directly and substantially in issue, supporting the doctrine of constructive res judicata.

Sections 19, 20 and 21 of the Administrative Tribunals Act, 1985 govern the filing and limitation of original applications; limitation is assessed by reference to accrual of the cause of action, and cannot ordinarily be postponed by making a belated representation.

The Tribunal applied Chief Executive Officer v. S. Lalitha, 2025 KHC 6393, and noted the distinction for continuing wrongs recognised in Union of India v. Tarsem Singh, (2008) 8 SCC 648.

Under paragraph 214(a) of the Indian Railway Establishment Manual and the relevant Railway instructions, promotion to non-selection posts could depend on suitability assessed through service records or departmental tests; the 2003 restructuring order did not itself dispense with the applicable selection or suitability requirements.

The Tribunal held that the applicant’s earlier application concerning the date of his second ACP provided an occasion to raise his grievance about non-promotion under the 2003 restructuring, but he did not do so; raising it years later amounted to impermissible piecemeal litigation and attracted constructive res judicata.

The claim was also stale: the later representations did not defer limitation, and the alleged denial of promotion was not treated as a continuing cause of action.

On eligibility, MSTC was a training course, not a substitute for the suitability test.

The applicant appeared for the 2014 test and failed, and later did not attend when called again; without qualifying for promotion as Senior Clerk, he could not be considered for the higher posts of Office Superintendent or Chief Office Superintendent.

No costs were ordered.
