01Facts
The Tribunal’s order dated 17 December 2024 directed the respondents to reconsider Sukhdev Singh’s ACR gradings for 1998–99, 1999–2000 and 2000–01 and issue a speaking order.
¶ 2It further directed that, if he was found eligible after reconsideration, a Special/Review DPC should consider him for promotion from the date his immediate junior was promoted.
¶ 3, 17The respondents constituted a committee and, by order dated 13 March 2025, declined to upgrade the gradings.
¶ 4Singh then sought execution, alleging that the order did not provide adequate reasons and therefore did not comply with the Tribunal’s directions.

i.1. Whether the respondents complied with the direction to reconsider Singh’s ACR gradings and pass a speaking order
¶ 16–18ii.2. Whether the execution proceeding could be used to revisit the merits or sufficiency of the administrative assessment made after reconsideration
¶ 19–21iii.3. Whether the respondents were required to convene a Special/Review DPC despite declining to upgrade the ACRs
¶ 17, 2003Law Applied
Section 27 of the Administrative Tribunals Act, 1985 and Rule 24 of the CAT (Procedure) Rules, 1987 were invoked as the procedural basis for seeking execution.
¶ 1In execution proceedings, the Tribunal determines whether the operative directions in the order sought to be executed have been complied with; execution ordinarily cannot be converted into a fresh adjudication of the merits of the administrative decision taken in response to that order, unless the decision is demonstrably contrary to or disregards its specific directions.
¶ 19Where a review DPC is expressly conditional on the applicant being found eligible after reconsideration, that obligation does not arise if the applicant is not found eligible.

Administrative Tribunals Act, 1985 Section 27
04Reasoning
The Tribunal found that the respondents had constituted a committee, considered the relevant ACRs and representation, and obtained a decision from the competent authority, which recorded reasons for refusing upgradation.
¶ 18The original order required reconsideration and a speaking order, not a particular outcome or automatic upgradation.
¶ 17, 20Singh’s objections concerning the correctness of the ACR assessments, supporting material and compliance with ACR-writing instructions challenged the merits of the administrative decision and could not be determined through execution absent a demonstrated departure from the original directions.
¶ 19, 21Because the reconsideration did not find him eligible, the conditional requirement to convene a Review/Special DPC was not triggered.
¶ 2005Holding
The Tribunal held that the respondents had complied with the operative directions by reconsidering the ACRs and issuing the speaking order dated 13 March 2025.
¶ 22As Singh was not found eligible, no Special/Review DPC was required.
¶ 22Finding no further executable direction outstanding, the Tribunal dismissed the Execution/Miscellaneous Application.
