In brief

The question

1. Whether the order rejecting Alam’s representation was adequate where it did not address the points he had raised.

The court held

The Tribunal set aside the order dated 25 February 2015 and allowed the application.

It also directed

It directed Alam to submit a fresh representation, with supporting documents and a copy of the order, within three weeks of receiving the order; the respondent concerned must then issue a reasoned and speaking order within three months of receiving that representation.

No order as to costs was made, and pending miscellaneous applications were disposed of.

01Facts

Afroz Alam applied for Gramin Dak Sevak Branch Postmaster posts at Jagannathpur and Hauj (Zafrabad), Jaunpur.

He alleged that he was overlooked despite his merit and that the successful candidates were lower-ranked.

The respondents stated that conflicting character and antecedent reports, including a further report referring to a criminal case under the Excise Act, led them to consider him unsuitable and offer the Hauj post to another candidate.

p. 3

Alam challenged the order dated 25 February 2015 rejecting his representation, which stated only that the appointments had been made according to the rules.

pp. 4–5

Before the Tribunal, his counsel sought reconsideration of the representation rather than pressing for an immediate appointment.

p. 4

02Issues

i.1. Whether the order rejecting Alam’s representation was adequate where it did not address the points he had raised.

pp. 4–5

ii.2. Whether the Tribunal should direct Alam’s appointment or instead require the respondents to reconsider his case by a reasoned order.

pp. 4–5

03Law Applied

The application was brought under Section 19 of the Administrative Tribunals Act, 1985.

p. 2

The Tribunal applied the principle that an administrative decision rejecting a representation must meaningfully address the issues raised and give reasons; a reasoned and speaking order is required.

04Reasoning

The Tribunal found that Alam’s representation, extending over more than three pages, had been rejected in a single sentence without dealing with the points he raised.

pp. 4–5

The rejection therefore did not constitute proper adjudication of the representation.

pp. 4–5

Since the applicant sought reconsideration and the record did not result in a determination of his entitlement to appointment, the Tribunal directed a fresh decision rather than ordering his appointment.

pp. 4–5
