01Facts
The respondent applied for recruitment as a Nursing Officer (Allopathic) under an advertisement dated 24 September 2021.
¶ 2–4The prescribed qualifications included a nursing qualification and registration as a Nurse or Nurse and Midwife with a State Nursing Council; the relevant eligibility date was 1 January 2021.
¶ 2–4The respondent had been registered by the Delhi Nursing Council as a Registered Nurse and Registered Midwife in August 2018.
¶ 5–7She later transferred her registration to Punjab and obtained a Post Basic B.Sc. Nursing qualification, which she held by 1 January 2021.
¶ 5–7The Staff Selection Commission rejected her candidature on the ground that she did not meet the educational-qualification requirement and that her registration was after the cut-off date.
¶ 8The Central Administrative Tribunal allowed her original application, finding that her 2018 registration satisfied the registration requirement.
¶ 9–10The Commission challenged that order before the High Court.
02Issues
i.Whether the respondent’s nursing registration, obtained before she acquired the prescribed Post Basic B.Sc. Nursing qualification, satisfied the advertisement’s registration requirement.
¶ 11–12ii.Whether the Tribunal’s order allowing the respondent’s application warranted interference under the High Court’s writ jurisdiction.
¶ 13–1503Law Applied
The Court applied the eligibility conditions in the recruitment advertisement, which required the specified nursing qualification and registration as a Nurse or Nurse and Midwife with a State Nursing Council.
¶ 3–4It held that, absent an express condition requiring nursing registration to be obtained after the prescribed educational qualification, the registration requirement could be met by a certificate issued before that qualification was obtained.
¶ 12The judgment cited no statute or precedent for this interpretation.
Provisions in the judgment · 1
Delhi Nursing Council Act, 1997 Section 14
04Reasoning
The respondent held the required Post Basic B.Sc. Nursing qualification by the eligibility date and had been registered as a nurse by the Delhi Nursing Council in 2018.
¶ 5, 7The advertisement did not state that registration had to follow acquisition of the prescribed nursing qualification.
¶ 12The Court therefore held that the earlier registration satisfied the registration condition, notwithstanding the sequence in which the respondent obtained her registration and qualification.
¶ 12It considered the Commission’s contrary interpretation legally unsustainable and unduly restrictive.
¶ 1305Holding
The High Court upheld the Tribunal’s decision.
¶ 15–16The High Court dismissed the Commission’s writ petition in limine, and directed that the Tribunal’s order be implemented within four weeks.
