01Facts
The respondents, teaching and academic staff in government colleges and technical institutions, were granted Career Advancement Scheme (CAS) promotion or placement.
¶ 1–2Initial orders provided monetary benefits from the date each employee became eligible.
¶ 1–2The State subsequently directed that benefits be prospective and modified the orders to make them effective from the date of the promotion order.
¶ 1–2The employees challenged that modification before the Karnataka State Administrative Tribunal, which set it aside and directed payment from the date of eligibility.
¶ 1–2The State challenged the Tribunal’s orders in these connected writ petitions.
¶ 1–202Issues
i.Whether CAS promotion and its monetary benefits take effect from the date of the promotion order or from the date the employee completes the minimum eligibility period, subject to successful assessment.
¶ 8ii.Whether an employee is entitled to CAS benefits from the date of acquiring the prescribed qualification under the applicable AICTE framework.
¶ 15–1803Law Applied
Under UGC Regulations 2010, Regulation 6.3.12(a), a candidate who applies on completing the minimum eligibility period and succeeds in assessment receives promotion effective from that eligibility date; under clauses (b) and (c), the effective date depends on when the candidate applies or succeeds after reassessment.
¶ 10The State’s CAS Guideline 8 applies the same approach: successful applicants receive promotion from the minimum eligibility date, while later applications and unsuccessful assessments are governed by the specific dates set out in the guideline.
¶ 11–12UGC Regulations 2018 require an application and assessment under the prescribed screening and evaluation process, but provide for timely completion of that process.
¶ 12Under AICTE Career Advancement Scheme Regulations 2012, Regulations 2.14 and 2.15 similarly make promotion effective from the date the minimum eligibility period is completed, or from the date of application where eligibility is fulfilled later; CAS is a personal promotion attached to the incumbent, and the post reverts to its original cadre on superannuation.
¶ 16–1804Reasoning
The Court held that the applicable UGC and State CAS provisions expressly determine the effective date of promotion after successful assessment; the later date on which the committee completes its assessment does not displace the date prescribed by those provisions.
¶ 10–12It rejected the State’s contention that benefits could begin only when employees assumed duties in a higher post: CAS is a personal advancement in pay and designation, not a promotion to a different post requiring performance of higher-post duties.
¶ 13–14In the AICTE case, the employee had acquired the Ph.D. and satisfied the other stated requirements; the applicable provisions therefore supported the effective date associated with fulfilment of eligibility, rather than the later order date.
¶ 15–1805Holding
The Court answered the issues in favour of the employees and dismissed both writ petitions.
¶ 19It upheld the Tribunal’s orders granting CAS promotion or placement and consequential monetary benefits from the applicable eligibility date, subject to successful assessment and the relevant eligibility conditions.
