Punitive transfer and spouse-posting request constitute distinct causes of action requiring separate consideration.

The applicant, a Technician ‘A’ in DRDO, was transferred from the Naval Materials Research Laboratory, Ambernath, to the Vehicles Research and Development Establishment, Ahmednagar, by order dated 18 February 2026.

The respondents described the transfer as being on punitive grounds and in public interest.

The applicant also challenged an order dated 18 December 2025 imposing withholding of annual increments for three years with effect from 1 January 2026, and sought opening of any sealed cover concerning his promotion.

He further sought transfer to a DRDO establishment in Delhi/NCR on spouse grounds, stating that his wife was employed with the Delhi Police and relying on DoP&T guidelines regarding posting of spouses.

After making several representations without obtaining the relief sought, the applicant filed the present Original Application.

1. Whether the applicant was entitled to have the punitive transfer order dated 18 February 2026 quashed.

2. Whether the applicant’s request for transfer to a DRDO establishment in Delhi/NCR on spouse grounds constituted an independent cause of action requiring separate consideration by the respondents.

3. Whether the applicant was entitled to relief against the penalty of withholding annual increments and to consequential promotion-related reliefs, including opening of the sealed cover.

The Tribunal applied the principle that distinct and independent causes of action—such as a challenge to a punitive transfer, a request for spouse-based posting, and a challenge to a disciplinary penalty—may require separate consideration.

It recognized that a request for transfer on spouse grounds is governed by the applicable Government/DoP&T policy and is subject to consideration by the competent authority in accordance with the rules.

Where such a representation is maintainable, the authority must consider it and pass a reasoned and speaking order within the prescribed period.

It directed the applicant to submit a fresh representation seeking transfer to a suitable DRDO establishment in Delhi/NCR on spouse grounds.

The respondents were directed to consider and dispose of that representation, if permissible under the rules, by passing a reasoned and speaking order within six weeks from receipt of a certified copy of the order.

The Tribunal did not grant the requested transfer, quash the punitive transfer or disciplinary penalty, restore the increments, or direct promotion or opening of the sealed cover.
