01Facts
The petitioner challenged an order concerning respondent Devi Singh’s placement as Senior Sheristedar, arguing that he lacked the 10+2 qualification introduced by the amendment to the Himachal Pradesh District Judiciary Staff (Recruitment, Promotion, Control, Conduct, Discipline and Other Conditions of Service) Rules, 2022, dated 16 October 2024.
pp. 2–4The respondents showed that Devi Singh had been promoted to Senior Sheristedar in 2017, when the applicable rules required only Matriculation and two years’ qualifying service, which he possessed.
pp. 5–7Before the petitioner filed the writ petition on 15 July 2025, Devi Singh had also been promoted to Chief Administrative Officer by notification dated 8 May 2025; that promotion was not challenged.
p. 4The petitioner maintained that the 2024 amendment rendered Devi Singh’s promotion to Senior Sheristedar, and consequently his promotion to Chief Administrative Officer, invalid.
pp. 6–702Issues
i.1. Whether the 2024 amendment to the 2022 Rules retrospectively invalidated Devi Singh’s 2017 promotion to Senior Sheristedar, which had been made under the rules then in force.
pp. 7–9ii.2. Whether the petitioner could challenge the consequential promotion to Chief Administrative Officer when that promotion had occurred before the writ petition was filed and was not itself challenged.
pp. 4–5, 603Law Applied
The Court applied the Himachal Pradesh District Judiciary Staff (Recruitment, Promotion, Control, Conduct, Discipline and Other Conditions of Service) Rules, 2022, including the 16 October 2024 amendment.
p. 3, 9It held that eligibility for promotion is assessed under the rules in force when the promotion is made; a later amendment introducing additional qualifications does not invalidate an earlier promotion that complied with the rules then applicable.
pp. 7–9The Court also treated the amendment as prospective, applying its revised eligibility requirements to appointments made after it came into force.
p. 904Reasoning
Devi Singh’s promotion to Senior Sheristedar took place in 2017, and the Court found that he met the eligibility requirements then in force.
pp. 7–8The 2024 amendment could not retrospectively undo that promotion merely because he did not possess the newly prescribed 10+2 qualification.
pp. 8–9The Court further observed that the amended qualification concerned promotion from specified feeder posts to Senior Sheristedar and did not govern Devi Singh’s existing status as Senior Sheristedar or his eligibility for selection as Chief Administrative Officer.
p. 9The latter promotion, moreover, had not been challenged.
pp. 4–505Holding
The Court rejected the challenge to the order concerning Devi Singh’s placement as Senior Sheristedar and dismissed the writ petition as misconceived.
pp. 9–10It held that the 2024 amendment did not invalidate his 2017 promotion, and dismissed the petitioner’s consequential prayers as well.
pp. 8–10Pending miscellaneous applications were also disposed of.
