04Reasoning
The Court considered the Will potentially material to the rights declared in the preliminary decree, including the nature and extent of any share allotted to Casmir D’Souza and his ownership of the property.
pp. 6–8 · ¶ 3–5It therefore found that the FDP Court had erred by rejecting the application and leaving the testamentary issue unresolved while the final decree proceedings continued.
pp. 6–8 · ¶ 3–5Because evidence on the Will had already been recorded in O.S. No. 149/2007, the Court directed that it be secured and placed on the FDP record, rather than permitting further adjudication in the disposed suit.
pp. 6–8 · ¶ 3–505Holding
The writ petition was allowed, and the order rejecting I.A. No. 17/2020 was set aside; the application was allowed.
pp. 9–10, order clauses (i)–(v)The FDP Court was directed to obtain and place on record the evidence concerning the Will already recorded in O.S. No. 149/2007, determine the Will’s genuineness and validity in accordance with law, and then proceed with the final decree in light of its findings.
pp. 9–10, order clauses (i)–(v)The Court also directed expedition.
