04Reasoning
The Court considered the prosecution’s allegation that the stolen rice had been recovered from the applicants and the State’s submission that their two live antecedents each indicated habitual offending.
¶ 2, 4It nevertheless found bail justified because the investigation was complete, the charge-sheet had been submitted, the applicants had been in custody since 29 July 2026, and the antecedent cases dated back to 2023.
¶ 6The Court expressly refrained from expressing any opinion on the merits.
¶ 605Holding
The Court allowed the bail application.
¶ 6–7It directed that the applicants be released upon executing a personal bond of ₹50,000 each with one surety for the like sum, to the satisfaction of the trial Court.
¶ 6–7The applicants must not induce, threaten, or promise anything to persons acquainted with the facts, must not prejudice a fair and expeditious trial, and must attend each trial-court date until disposal of the trial.
¶ 7The observations were limited to the bail application, and the trial Court was directed to decide the case on its own merits.
