01Facts
The appellant claimed rebate of service tax under Rule 5 of the Cenvat Credit Rules, 2004, read with Notification No. 11/2005-ST, for services exported between April and June 2012.
p. 1The original authority sanctioned part of the claim but rejected Rs. 45,52,322; the Commissioner (Appeals) upheld the rejection.
p. 1The original authority had considered Rs. 1,04,60,578 of the claim and rejected Rs. 33,59,000 for non-production of documents.
p. 302Issues
i.1. Whether rebate could be rejected on the ground that input services lacked nexus with the exported output services, where the export and the conditions of Notification No. 11/2005-ST were otherwise satisfied
p. 4ii.2. Whether the claim required remand for verification where supporting documents were not produced or the tax payment on certain invoices could not be ascertained
pp. 3–403Law Applied
Rule 5 of the Cenvat Credit Rules, 2004, read with Notification No. 11/2005-ST, provides for rebate in respect of service tax paid on exported services, subject to the notification’s conditions, limitations and procedures.
pp. 1–2The Tribunal applied the principle that, where services have been exported and the notification’s conditions are satisfied, rebate cannot be denied merely on the basis of the nexus of input services with the exported services.

04Reasoning
The Tribunal accepted that the original authority had recorded that the appellant exported services, received consideration in convertible foreign exchange and satisfied the notification’s conditions.
pp. 2–3However, the amount rejected for non-production of documents required verification, as did the Rs. 6,06,027 relating to invoices for which payment of tax could not be ascertained.
pp. 3–405Holding
The Tribunal held that rebate could not be denied merely for lack of nexus between input services and exported services where the relevant export conditions were met.
p. 4The appeal was allowed by way of remand.
