01Facts
The petitioners were selected through a recruitment process initiated in April 2008 for direct recruitment to Assistant Engineer (Civil) posts. The Public Service Commission recommended them on 4 November 2008; after approval and completion of formalities, they received appointment orders on 9 January 2009.
¶ 2–12Meanwhile, the State promoted Junior Engineers to Assistant Engineer posts during 2008. In the seniority list dated 24 May 2011, the petitioners were placed below the 2008 promotees. After their objections were rejected, they sought quashing of the relevant memoranda and seniority according to the applicable recruitment roster.
¶ 2–12The State maintained that the petitioners could not claim seniority before appointment and that the promotions were justified by vacancies, including upgraded posts.
¶ 13–1702Issues
i.1. Whether direct recruits whose recruitment process began in 2008, but who were appointed in January 2009, could be assigned seniority at their 2008 roster points under the applicable Recruitment and Promotion Rules.
¶ 20, 25–29ii.2. Whether the State’s seniority list, which placed the petitioners below the 2008 promotees, disregarded the prescribed quota-rota roster and thereby violated Articles 14 and 16 of the Constitution.
¶ 29, 32–3803Law Applied
The Himachal Pradesh Department of Irrigation and Public Health, Assistant Engineer (Civil), Class-I (Gazetted) Technical Services, Recruitment and Promotion (Third Amendment) Rules, 2005 prescribed recruitment by direct recruitment and promotion in a 25:75 ratio and provided for roster-based placement.
¶ 26, 39The Court applied the principle in S.G. Jaisinghani v. Union of India, AIR 1967 SC 1427, that a prescribed quota is binding and cannot be disregarded at the Government’s discretion; quota and seniority rules must operate consistently.
¶ 28It also relied on V.B. Badami v. State of Mysore, AIR 1980 SC 1561, on the limits of promotions made beyond the prescribed quota.
¶ 30It also relied on All India Judges Association v. Union of India, 2025 INSC 1328, for the proposition that, in the circumstances described there, appointees may be placed at roster points for the year recruitment began, subject to the stated conditions.
¶ 31The Court held that the applicable roster had to be followed in fixing seniority and that disregarding it could offend Articles 14 and 16.
¶ 29, 3304Reasoning
The Court found that the State had initiated direct recruitment in April 2008, the Commission recommended the petitioners on 4 November 2008, and the State approved their appointment before the end of that year.
¶ 26, 35It concluded that the later issue of appointment orders did not justify placing them below promotees without regard to the prescribed roster.
The State’s reliance on upgraded posts and the need to make promotions did not displace the roster or permit promotions to prejudice the direct recruits’ roster-based seniority.
¶ 27, 33, 37–38The Court distinguished M. Thanigivelu because the seniority framework considered there differed from the roster prescribed by the Rules in this case.
¶ 3505Holding
The Court allowed the petition, quashed the memoranda dated 25 May 2011 and 24 May 2011, and directed the State to assign the petitioners seniority according to the roster under the 2005 Rules, with consequential benefits.
¶ 39The petition was disposed of without an order as to costs.
