01Facts
The Plaintiff claimed prior use of “EDUCOMP SMARTCLASS” from 2003 and sought an injunction and damages against the Defendants’ use of “SAMSUNG SMARTCLASS” for digital classroom services.
¶ 1–5An ex parte interim injunction was vacated after the Court noted evidence of the Defendants’ use from 2013 and a 2015 purchase order referring to the Impugned Mark.
¶ 5–6The Plaintiff’s evidence was closed in 2019 after multiple opportunities; the Suit was later dismissed for non-prosecution and restored in 2024.
¶ 8–9At trial, the Plaintiff did not adduce evidence establishing distinctiveness, goodwill, or damages.

i.Whether the Defendants infringed the Plaintiff’s registered “EDUCOMP SMARTCLASS” trademark.
¶ 7(i)ii.Whether the Plaintiff was entitled to a permanent injunction, including on the ground of passing off.
¶ 7(ii), 22–25iii.Whether the Plaintiff was entitled to damages and, if so, to what extent.
¶ 7(iii), 26–28iv.Whether Defendant No. 1 was improperly impleaded as neither a necessary nor a proper party.
¶ 7(iv)03Law Applied
The Court assessed infringement by reference to the rights conferred by the registered marks as a whole and whether the competing marks, considered in their entirety, were likely to cause confusion or association among the relevant public; registration of a composite mark does not, by itself, confer an exclusive right over a component absent evidence of its independent distinctiveness.
¶ 17–20A passing-off claim requires proof of goodwill and reputation, misrepresentation, and resulting or likely damage.
¶ 23–24The Court also held that a director’s association with a company, without evidence of an independent role or personal involvement, does not by itself establish personal liability.
¶ 30The Plaintiff cited authorities on deceptive similarity and likelihood of confusion, but the Court found that they did not advance its case on the facts.

04Reasoning
The Plaintiff’s registrations and applications did not establish that “SMARTCLASS” had acquired distinctiveness independently of its composite marks, and the Plaintiff’s failure to adduce evidence left its claims of use, goodwill, and public association unsubstantiated.
¶ 15–16The Court therefore assessed the marks as wholes, noting their different house marks—“EDUCOMP” and “SAMSUNG”—and found no proof that the Impugned Mark was likely to cause confusion or association.
¶ 17–20For the same evidentiary reasons, the Plaintiff failed to establish goodwill in “SMARTCLASS” or misrepresentation by the Defendants, particularly in light of the prominent “SAMSUNG” mark.
¶ 24The Plaintiff also provided no evidence of loss or its quantification.
¶ 26–28Finally, it did not prove Defendant No. 1’s personal involvement in the alleged conduct.
¶ 3005Holding
The Court decided all issues against the Plaintiff. It found no infringement or passing off, denied the injunction and damages, and directed that Defendant No. 1 be deleted from the array of parties.
¶ 21, 25, 28, 31–33The Suit was dismissed without an order as to costs.
