In brief

The question

Whether the applicant’s adjustment to UEED Division Kulgam-Shopiyan, allegedly without a sanctioned Orderly post and outside his District Cadre, should be set aside.

The court held

The O.A. was disposed of without quashing the adjustment order or the disciplinary-related communications, and without directing the applicant’s restoration to his Srinagar posting.

It also directed

The respondents were directed to treat the O.A. as a representation alongside the representation dated 16 October 2026, afford the applicant a personal hearing, and decide the matter in accordance with law within two weeks, taking account of the cited authorities and the Council of Ministers’ decision.

No opinion was expressed on the merits, and no order was made as to costs.

01Facts

The applicant, an Orderly in the Urban Environmental Engineering Department (UEED) and a member of the Srinagar District Cadre, had been posted in the Sewerage & Drainage Division-I, Srinagar.

¶ 2, 4

Following departmental reorganisation, the Chief Engineer issued an order adjusting him, on a stop-gap basis, to the newly constituted UEED Division Kulgam-Shopiyan.

¶ 3–5

The applicant contended that no Orderly post was sanctioned for that Division and that the adjustment placed him outside his District Cadre.

¶ 3–5

After he represented against the adjustment, the Department directed initiation of disciplinary action for not routing his representation through the proper channel; a subordinate officer subsequently reported that his reply was unsatisfactory.

¶ 6–8

The applicant sought, among other reliefs, quashing of the adjustment and related communications, and restoration to his Srinagar posting.

¶ 1

At his counsel’s request, the Tribunal took up the O.A. for disposal.

¶ 13

02Issues

i.Whether the applicant’s adjustment to UEED Division Kulgam-Shopiyan, allegedly without a sanctioned Orderly post and outside his District Cadre, should be set aside.

¶ 4–5, 11

ii.Whether the communications initiating or pursuing disciplinary action following the applicant’s representation should be quashed or otherwise restrained.

¶ 6–8

iii.Whether the applicant’s representation and the issues raised in the O.A. should be considered by the respondents, with a personal hearing and within a specified period.

¶ 14

03Law Applied

The Tribunal reiterated that transfer and posting are ordinarily matters for the competent authority, which is best placed to assess public and administrative interest; an employee has no right to a posting of choice, and judicial interference is limited.

¶ 10

It cited authorities including Union of India v. S.L. Abbas, (1993) 4 SCC 357, and State of U.P. v. Gobardhan Lal, (2004) 11 SCC 402, among others, for those principles.

¶ 10

The applicant relied on P.K. Chinnasamy v. Government of Tamil Nadu, (1987) 4 SCC 601, in support of the proposition that an employee should be assigned work commensurate with his position.

¶ 11

The Tribunal directed the respondents to consider the matter in accordance with law, taking account of the cited law and Council of Ministers’ Decision No. 121/18/2025 dated 3 December 2025; it did not determine the substantive legality of the adjustment or disciplinary communications.

¶ 14

Provisions in the judgment · 1

Jammu and Kashmir Civil Services Decentralization and Recruitment Act, 2010 Section 2

04Reasoning

The Tribunal acknowledged the applicant’s challenge to an adjustment allegedly made without an identified sanctioned post and to disciplinary steps following his representation, but did not decide those challenges on their merits.

¶ 4–8, 14

Instead, it treated the O.A., together with the applicant’s representation dated 16 October 2026, as a matter for the respondents to consider and decide.

¶ 14

In doing so, it required them to consider the merits, the cited legal principles, and the Council of Ministers’ decision, and to provide the applicant a personal hearing.

¶ 14

The Tribunal expressly left the merits open for the respondents’ determination under the applicable rules.

¶ 14

05Holding

The O.A. was disposed of without quashing the adjustment order or the disciplinary-related communications, and without directing the applicant’s restoration to his Srinagar posting.

¶ 14–15

The respondents were directed to treat the O.A. as a representation alongside the representation dated 16 October 2026, afford the applicant a personal hearing, and decide the matter in accordance with law within two weeks, taking account of the cited authorities and the Council of Ministers’ decision.

¶ 14

No opinion was expressed on the merits, and no order was made as to costs.
