In brief

The question

1. Whether the Junior Pontiff claimed the Society’s chairmanship as Peethadhikari or as a member, and, if as a member, when he was enrolled.

The court held

The Court disposed of the connected writ petitions without deciding which group was lawfully elected.

It also directed

It directed the District Registrar to inquire into the Junior Pontiff’s basis for claiming the chairmanship and the statutory validity of both groups’ meetings, and to complete the inquiry within two months of receiving the certified order.

The impugned communication rejecting the Senior Pontiff group’s report and the order accepting the Junior Pontiff group’s report were to remain in abeyance pending that determination.

If a serious dispute arose over the Junior Pontiff’s Society membership, the parties were to be relegated to the civil court.

01Facts

The dispute concerns the management of Sri Jagadguru Shivananda Vidyavarthaka Samsthe, whose bye-laws provide that the Math’s Peethadhikari is its permanent President.

¶ 3–5

Two rival groups—one led by the Senior Pontiff and the other by the Junior Pontiff—claimed to have elected the Society’s Managing Committee and filed competing returns with the District Registrar.

¶ 3–5, 11–15

The Junior Pontiff’s claim to be Peethadhikari was also pending in a civil suit; an earlier High Court order had limited his participation in the Math’s affairs and directed him not to disturb its management.

¶ 9, 18–19

The Registrar rejected the Senior Pontiff group’s returns but accepted the Junior Pontiff group’s returns, prompting the connected petitions.

¶ 14–16

02Issues

i.1. Whether the Junior Pontiff claimed the Society’s chairmanship as Peethadhikari or as a member, and, if as a member, when he was enrolled.

¶ 30(i)

ii.2. Whether the general body meeting at which the Junior Pontiff claimed election as Chairman complied with statutory requirements.

¶ 30(ii)

iii.3. Whether the general body meeting conducted by the Senior Pontiff complied with statutory requirements.

¶ 30(iii)

iv.4. Whether the competing election and membership disputes could be determined in these writ proceedings, or required inquiry by the Registrar or adjudication by a civil court.

¶ 29–31

03Law Applied

The Karnataka Societies Registration Act, 1960, including Sections 13 and 25, provides the statutory framework for Society returns and related inquiries; the judgment notes that separate inquiries under those provisions had previously been directed.

¶ 6–8

The Court also applied the principle that contested questions of membership, the validity of competing elections, and compliance with statutory requirements involve complex factual disputes unsuitable for determination in writ jurisdiction under Articles 226 and 227.

¶ 29

Where a serious dispute arises over membership, the parties may be relegated to the civil court for adjudication of their rights and obligations.

¶ 31

The Court considered the earlier order in W.P. No. 107781/2023, which restricted the Junior Pontiff’s role in the Math pending the civil suit.

Provisions in the judgment · 2

Karnataka Societies Registration Act, 1960. Section 13Section 25

04Reasoning

The Junior Pontiff could not rely on his disputed status as Peethadhikari to claim the Society’s chairmanship because that status was pending determination in the civil suit and was subject to the earlier High Court order.

¶ 26–27

His alternative claim—that he was elected as a Society member—was disputed, as were the validity of both groups’ meetings and elections.

¶ 28–29

Because those issues required factual adjudication, the Court directed the District Registrar to examine the specified questions, while leaving any serious membership dispute to the civil court.

¶ 29–31

05Holding

The Court disposed of the connected writ petitions without deciding which group was lawfully elected.

¶ 36

It directed the District Registrar to inquire into the Junior Pontiff’s basis for claiming the chairmanship and the statutory validity of both groups’ meetings, and to complete the inquiry within two months of receiving the certified order.

¶ 30, 34

The impugned communication rejecting the Senior Pontiff group’s report and the order accepting the Junior Pontiff group’s report were to remain in abeyance pending that determination.

¶ 32–33

If a serious dispute arose over the Junior Pontiff’s Society membership, the parties were to be relegated to the civil court.
