In brief

The question

1. Whether the Trial Court’s judgment, delivered while an order staying further proceedings was in force, should be set aside.

The court held

The appeal was allowed, and the Trial Court’s judgment and decree dated 10 February 2020 were set aside.

It also directed

The matter was remitted for fresh consideration from the stage of I.A. No. 20 under Order VI Rule 17 read with Section 151 CPC; the earlier order rejecting that application was also set aside.

The Trial Court may frame additional issues, all parties’ contentions remain open, and the parties were directed to appear on 23 November 2026 without further notice.

The Trial Court was directed to dispose of the matter as early as possible.

01Facts

The plaintiffs claimed rights over 28 guntas in Sy. No. 29/1 and sought, among other reliefs, changes to the khatha and an injunction concerning the property.

pp. 5–8

After the suit was posted for arguments, they applied under Order VI Rule 17 CPC to amend the plaint. The Trial Court rejected that application; the plaintiffs challenged the rejection in a writ petition.

pp. 5–8

On 7 February 2020, the High Court stayed further proceedings in the suit. Although the plaintiffs brought the stay order to the Trial Court’s attention, the Trial Court proceeded to dismiss the suit on 10 February 2020, stating that the online case status did not show the stay.

pp. 5–8

In the appeal, the defendants’ counsel conceded that the judgment had been passed while the stay was in force.

pp. 5–8

04Reasoning

The High Court verified from the order sheet in the writ petition that it had stayed all further proceedings in the suit on 7 February 2020. The Trial Court nevertheless pronounced judgment three days later, despite the plaintiffs’ memo notifying it of the stay; the online case status did not disclose the order.

pp. 7–9

The defendants conceded that the judgment was delivered during the stay. In those circumstances, the Court considered remand appropriate and directed that the matter return to the stage of considering the amendment application, rather than leaving the dismissal in place.

pp. 7–9
