In brief

The question

Whether reducing the pension-withholding penalty from 50% to 5%, while leaving the penalty otherwise intact, entitled the petitioner to have his suspension period regularized as duty.

The court held

The Court answered both issues against the petitioner. It held that reducing the pension-withholding penalty did not entitle him to regularization of the suspension period or consequential time-bound advancement.

It also directed

dismissed the writ petition

01Facts

The petitioner, a retired Deputy Director, was penalized by an order dated 3 April 2014, including recovery of 50% of the loss caused to the State and withholding 50% of his pension. The Karnataka State Administrative Tribunal dismissed his challenge to that penalty. In W.P. No. 14068 of 2021, the High Court reduced the pension withholding from 50% to 5%, leaving the remaining penalty intact.

pp. 3–5, 8

The petitioner later sought to have his suspension period, 7 May 2008 to 10 October 2010, treated as duty and to receive time-bound advancement. The authorities rejected the request, and the Tribunal dismissed his challenge to that rejection. He then filed the present writ petition.

pp. 5–6

02Issues

i.Whether reducing the pension-withholding penalty from 50% to 5%, while leaving the penalty otherwise intact, entitled the petitioner to have his suspension period regularized as duty.

pp. 5–6, 8

ii.Whether the petitioner was consequently entitled to time-bound advancement for that period, and whether the Tribunal’s refusal to grant that relief involved error or illegality.

p. 6, 9

03Law Applied

The Court referred to Rules 99 and 100 of the Karnataka Civil Services Rules (KCSRs), stating that they provide for regularization of a suspension period where the employee is exonerated of the charges.

p. 8

The Court’s stated rule was that an employee who has not been exonerated of the charges is not entitled to regularization of the suspension period; without such regularization, the petitioner was not entitled to time-bound advancement for that period.

pp. 8–9

04Reasoning

The Court found that the petitioner’s charges remained proved and that the earlier order had modified only the extent of pension withholding; it had not set aside the penalty or exonerated him.

p. 8

Because he was not exonerated, the Court held that Rules 99 and 100 did not entitle him to have the suspension period regularized as duty. His claim to time-bound advancement, which depended on that regularization, therefore also failed. The Court found no error or illegality in the Tribunal’s decision.

pp. 8–9

05Holding

The Court answered both issues against the petitioner. It held that reducing the pension-withholding penalty did not entitle him to regularization of the suspension period or consequential time-bound advancement.
