In brief

The question

Whether the petitioner, who had relinquished promotion and retired without serving as a Headmaster, was entitled to notional promotion to that post

The court held

The Court dismissed the writ petition, declining to set aside the Director’s order or direct notional promotion.

It also directed

No costs were awarded, and the connected miscellaneous petition was closed.

01Facts

The petitioner, a PG Assistant (Economics), retired on superannuation on 30 June 2026. He claimed that a Headmaster post had not been disclosed on the online counselling portal and sought notional promotion to that post.

p. 2

In an earlier writ petition, the Court held that he had relinquished promotion and could not claim promotion as of right for three years, while granting liberty to pursue his claim and directing the Director of School Education to decide any appeal.

p. 2

The Director rejected the petitioner’s appeal for notional promotion. The petitioner challenged that decision in the present writ petition.

pp. 2–3

02Issues

i.Whether the petitioner, who had relinquished promotion and retired without serving as a Headmaster, was entitled to notional promotion to that post

pp. 2–4

ii.Whether the alleged non-disclosure of the post during online counselling entitled the petitioner to relief despite his relinquishment and subsequent retirement

p. 3

03Law Applied

Section 48(1) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016, was relied on by the respondents in opposing consideration of the petitioner’s claim following his relinquishment.

p. 3

The Court also considered Government of West Bengal v. Dr. Amal Satpathi, 2024 SCC OnLine SC 3512, which recognises a right to be considered for promotion but not an absolute right to promotion; promotion takes effect upon assumption of duties in the promotional post, and retirement before promotion is effectuated does not confer retrospective financial benefits attached to that post.

pp. 4–5

Tamil Nadu Government Servants (Conditions of Service) Act, 2016 Section 48

04Reasoning

The petitioner argued that the alleged concealment of the post on the counselling portal was the respondents’ error and should not disentitle him to notional promotion.

p. 3

The Court nevertheless considered the prior finding that he had relinquished promotion, the Director’s decision, and the principle in Amal Satpathi that promotion becomes effective upon assumption of duties.

pp. 2–5

As the petitioner had retired without serving as Headmaster, the Court declined to grant the claimed notional promotion.

p. 5

05Holding

The Court dismissed the writ petition, declining to set aside the Director’s order or direct notional promotion.

p. 5

No costs were awarded, and the connected miscellaneous petition was closed.
