Facts

The applicant, a retired Railway employee, sought arrears of pay for two suspension periods, MACP benefits, and gratuity. He had been suspended from service in connection with a criminal case, was convicted and sentenced to life imprisonment on 4 August 2008, and was later released on bail after the High Court suspended execution of the sentence pending his appeal.

His representation for the claimed benefits was rejected on 19 November 2021. The Tribunal had previously directed the competent authority to decide his representation by a reasoned order. The applicant challenged the rejection in this O.A.

Issues

Whether the applicant’s gratuity could be withheld while his criminal appeal remained pending.

Law Applied

Rule 10(1)(c) of the Railway Services (Pension) Rules, 1993, as applied by the Tribunal, bars payment of gratuity until the conclusion of relevant judicial or departmental proceedings and the issuance of final orders, subject to the rule’s stated exception.

Suspension of a sentence and grant of bail do not, by themselves, set aside the conviction.

Entitlement to pay and allowances for a suspension period must be determined under the applicable provisions, including Fundamental Rule 54-B; reinstatement does not automatically entitle an employee to full pay, and the competent authority must assess whether the suspension was wholly unjustified and pass an order in accordance with the rule (Greater Hyderabad Municipal Corporation v. M. Prabhakar Rao, (2011) 8 SCC 155).

MACP entitlement must be assessed independently under the applicable MACP Scheme and Railway Board instructions, including the employee’s qualifying service and prior financial upgradations.

Reasoning

The Tribunal held that the pending criminal appeal did not erase the trial court’s conviction and that Rule 10(1)(c) therefore precluded an order directing immediate payment of gratuity while the judicial proceedings remained pending.

But that rule concerned gratuity and did not resolve the claims for suspension-period pay or MACP. Those claims required separate assessment under the governing service rules and instructions. The impugned order was set aside to the extent it rejected those claims without proper consideration, and the competent authority was directed to issue a reasoned decision.

Holding

The O.A. was partly allowed. The Tribunal declined to direct immediate release of gratuity, leaving entitlement subject to the applicable rules and the outcome of the criminal proceedings.

It set aside the impugned order insofar as it rejected the claims for suspension-period pay and MACP without proper consideration, and directed the competent authority to reconsider those claims and pass a reasoned order within three months of receiving a certified copy of the judgment. No costs were awarded.
