Promotion may be deferred during pending disciplinary proceedings; belated retrospective promotion claims are unsustainable.

The applicant joined the Railway Service as an Assistant Station Master on 29 January 1991 and retired on 31 December 2022.

A charge-sheet under Rule 9 of the Railway Servants (Discipline and Appeal) Rules, 1968, was issued to him on 14 May 2003 concerning alleged errors in declaring the ages of family members in an application for temporary withdrawal from his provident fund; he submitted his reply on 17 June 2003.

While the disciplinary proceeding was pending, the applicant was included in the promotion list from the Grade of Rs. 5,000–8,000 to Rs. 5,500–9,000, but was not promoted because of the pending proceeding.

The proceeding concluded on 17 May 2006 with the penalty of stoppage of increment, without cumulative effect, for one year, following which he was promoted to the higher grade with effect from 18 May 2006.

The applicant claimed promotion from 1 November 2003, alternatively from 1 January 2004, contending that the disciplinary proceeding had been unduly delayed.

His earlier O.A. No. 88/2011 was disposed of with liberty to pursue the promotion claim separately.

His subsequent O.A. No. 18/2017 resulted in an order dated 25 January 2024 remanding the matter to the Railway authorities for reconsideration and a reasoned order.

The authorities rejected the claim by order dated 23 August 2024, leading to the present application.

Whether the applicant was entitled to retrospective promotion to the Grade of Rs. 5,500–9,000 with effect from 1 November 2003 or 1 January 2004, despite the pendency of disciplinary proceedings against him.

Whether the Railway authorities’ decision to promote the applicant only with effect from 18 May 2006 was legally unsustainable and liable to be quashed.

Whether the applicant’s claim was liable to be rejected on account of the substantial delay of approximately twenty years in approaching the Tribunal.

The Tribunal applied Rule 9 of the Railway Servants (Discipline and Appeal) Rules, 1968, under which disciplinary proceedings could be instituted and continued against the applicant.

It also applied the administrative service principle that an employee facing a pending disciplinary proceeding may not be granted promotion until the proceeding is concluded, and that the promotion date may consequently follow the completion of the proceeding.

The Tribunal further considered the principle that stale claims and claims pursued after substantial delay may be declined, particularly where the administrative decision has long remained operative.

No judicial precedent was cited or relied upon in the order.

The Tribunal found that the applicant’s promotion became due while the disciplinary proceeding was pending. Since the charge-sheet had been issued and the proceeding had not concluded, the respondents were justified in withholding promotion at that stage.

After the proceeding concluded on 17 May 2006 and the penalty was imposed, the applicant was promoted from 18 May 2006, which the Tribunal treated as legally proper.

The Tribunal also noted that the promotion order did not confer promotion from 1 November 2003 and that the applicant’s claim had been raised after an approximately twenty-year delay.

On these facts, it found no sufficient basis to interfere with the promotion order or to grant retrospective pay, allowances, pensionary and consequential benefits.

The challenge to the orders dated 17 October 2007, 17 February 2016 and 23 August 2024 was rejected. The Original Application was dismissed for lack of merit, with no order as to costs.
