01Facts
The applicant, a retired teacher, was appointed in 1975, promoted as a Master in 1996 and placed in charge as Headmaster in her own pay and grade from 4 April 2008 until her retirement on 31 August 2012.
¶ 1Although other in-charge Headmasters were regularized in 2023 and 2025, she was not included in those exercises.
¶ 2–3Her earlier application was disposed of with a direction to treat it as a representation, but she claimed that her grievance remained unresolved.
¶ 3After the Government constituted a Committee in September 2026 to review claims by retired in-charge Headmasters who may have been excluded from regularization, she sought consideration of her claim, including consequential service and pensionary benefits.
¶ 4At the hearing, she sought an order treating the present application as a representation; the respondents did not oppose disposal with appropriate directions.
¶ 5–602Issues
i.1. Whether the Tribunal should direct the respondents to treat the Original Application and its annexures as a representation and consider the applicant’s claims under Government Order No. 385-JK(Edu) of 2026.
¶ 5, 8–9ii.2. Whether the Tribunal should determine the applicant’s substantive entitlement to retrospective regularization and consequential benefits in this proceeding.
¶ 9, 1103Law Applied
The Tribunal directed consideration in light of Government Order No. 385-JK(Edu) of 2026 dated 21 September 2026, which provides for a Committee-led reconciliation and verification exercise concerning retired in-charge Headmasters who claim to have been excluded from regularization.
¶ 4, 9The decision also requires the competent authority to apply the relevant rules, regulations, government orders and governing law, subject to the applicant establishing eligibility and entitlement and there being no legal impediment.
¶ 9The Tribunal cited no statute or precedent as the basis for determining the merits; it expressly left the factual and legal questions open.
¶ 1104Reasoning
The applicant limited her requested relief to a direction for administrative consideration, and the respondents accepted disposal with appropriate directions without prejudice to the parties’ rights.
¶ 5–6Given that limited prayer and the 2026 Government Order establishing a review mechanism, the Tribunal considered it unnecessary to keep the application pending and directed the respondents to assess the claim under that Order and the applicable legal framework.
¶ 8–10It did not assess whether the applicant was entitled to regularization or benefits, leaving those questions to the competent authority.
¶ 1105Holding
The Tribunal disposed of the application without expressing any opinion on its merits.
¶ 9–12It directed the respondents to treat it as a representation and pass a detailed, reasoned and speaking order on the applicant’s claims for retrospective regularization, consequential service and monetary benefits up to retirement, and pension refixation and arrears, within ten weeks of service of a certified copy of the order.
¶ 9–12No order as to costs was made.
