01Facts
The petitioner, the daughter of a deceased employee who had worked as a peon under respondent No. 3, sought compassionate appointment after her mother—who had earlier received compassionate appointment following the employee’s death—also died.
¶ 1–3Her application was rejected on the ground that she had exceeded the maximum age of 45 years under the State Government Policy dated 14 June 2013. She challenged the rejection orders dated 9 January 2026 and 27 July 2026, relying on a 22 November 2007 circular providing for age relaxation in the case of a deceased employee’s widow.
¶ 5–602Issues
i.1. Whether the petitioner, as the deceased employee’s daughter, was eligible for compassionate appointment despite having exceeded the 45-year age limit prescribed by the policy dated 14 June 2013.
¶ 3, 5ii.2. Whether the age relaxation provided by the circular dated 22 November 2007 for a deceased employee’s widow applied to the petitioner.
¶ 2, 603Law Applied
Clause 11 of the State Government Policy dated 14 June 2013 prescribes a maximum age of 45 years for candidates seeking compassionate appointment.
¶ 3, 5The circular dated 22 November 2007 provides for relaxation of the maximum age limit in the case of a deceased employee’s widow; the Court held that this provision does not extend to the deceased employee’s daughter.
¶ 5–604Reasoning
The Court found that the petitioner was the deceased employee’s daughter and had crossed the 45-year age limit prescribed by Clause 11. It therefore held that rejection of her application on that ground involved no illegality.
¶ 5–6The widow-specific relaxation in the 2007 circular could not assist her because she was the daughter, not the widow, of the deceased employee.
¶ 5–605Holding
The Court answered both issues against the petitioner, found no merit in the writ petition, and dismissed it.
¶ 7The challenged rejection orders were not quashed, and no relief was granted.
