The question

Whether the petitioners were entitled to pay-scale revision and consequential arrears for the period from 1 January 2006 to 31 October 2011.

The court held

The petition was disposed of in terms of the order dated 12 August 2026 in WPS No. 5791 of 2026.

It also directed

Accordingly, the petitioners’ entitlement to the specified pay revisions and arrears, subject to verification and calculation by the authorities, was governed by the directions set out in that order.

01Facts

The petitioners, former employees who had worked under the respondent department in various posts, challenged the State’s decision dated 2 March 2012 denying them revision of pay scales for the period from 1 January 2006 to 31 October 2011.

¶ 1

Counsel for the parties submitted that the issue had already been decided in Gopinath Pillai & Others v. State of Chhattisgarh & Others, WPS No. 5791 of 2026, by order dated 12 August 2026.

¶ 2

02Issues

i.Whether the petitioners were entitled to pay-scale revision and consequential arrears for the period from 1 January 2006 to 31 October 2011.

¶ 2–4

03Law Applied

The Court relied on its prior decision in WPS No. 5791 of 2026, which had applied the Supreme Court decisions in Bihar State Beverages Corporation Ltd. and Satya Brata Chowdhury and followed the High Court’s common order dated 11 July 2024 in WPS No. 697 of 2013 and connected matters, affirmed by the Division Bench in WA No. 622 of 2024 on 30 September 2024.

¶ 2

Under the operative direction in that earlier order, the quashing of the circular dated 2 March 2012 entitled the petitioners to the benefit of the Sixth Pay Commission and other salary revisions for the period from 1 January 2006 to 31 October 2011; the authorities were to verify and calculate arrears, decide the representation, and make payment preferably within 150 days of receiving the order.

¶ 2, quoting para. 7 of the order in WPS No. 697 of 2013

04Reasoning

The Court found that the facts and issue in the present petition were identical to those in WPS No. 5791 of 2026.

¶ 3

It therefore saw no basis to depart from the prior ruling and disposed of the petition on the same terms.

¶ 3–4
