In brief

The question

1. Whether the custodial sentences imposed on the appellants should be reduced to the period already undergone, while their convictions remained undisturbed.

The court held

The Court affirmed the convictions of Koksingh, Kaptan Singh and Dharusingh under the specified IPC provisions and reduced their custodial sentences to the periods already undergone.

It also directed

It enhanced the fines as set out in paragraph 10, directed that the enhanced amounts be paid within two months, and ordered that amounts already deposited be adjusted. The judgment states that, in default of payment, the sentence imposed by the trial court would apply.

The appellants’ bail bonds were discharged, and the appeal was disposed of with these modifications.
