In brief

The question

Whether the applicants, having completed the prescribed regular service and subsequently qualified CTET, could be considered for promotion to Headmaster through the DPC, subject to satisfying the other applicable eligibility conditions.

The court held

The Tribunal disposed of the OA by directing the respondents to consider the applicants’ candidature for promotion to Headmaster through the DPC, subject to verification that they satisfy all other applicable eligibility conditions.

It also directed

If an applicant secures the requisite merit position and is otherwise eligible, the respondents must consider that candidature for further stages of the selection process in accordance with law.

Pending miscellaneous applications were also disposed of, with no order as to costs.

01Facts

The applicants were serving as Primary Teachers (PRTs) in Kendriya Vidyalaya Sangathan (KVS) and sought consideration for promotion to Headmaster through the Departmental Promotion Committee (DPC).

¶ 1

KVS’s circular dated 9 June 2026 invited applications for promotion against vacancies up to December 2025 and required applicants to have five years’ regular service as PRTs and CTET Paper-I qualification.

¶ 5

The applicants could not apply because they had not qualified CTET in 2025; they subsequently qualified in the examination held on 8 February 2026, with results declared on 30 March 2026.

¶ 4–6

They approached the Tribunal seeking consideration of their candidature, relying on the Tribunal’s earlier decision in Anju Meena & Ors., OA No. 2265/2026, decided 7 September 2026.

¶ 7–9

02Issues

i.Whether the applicants, having completed the prescribed regular service and subsequently qualified CTET, could be considered for promotion to Headmaster through the DPC, subject to satisfying the other applicable eligibility conditions.

¶ 8

ii.Whether their candidature could be considered in light of the Tribunal’s earlier decision in Anju Meena & Ors.

¶ 7–9

03Law Applied

The Tribunal referred to the KVS Recruitment Rules of 2012 and their 2014 revision, which provided for filling Headmaster posts equally through promotion and the Limited Departmental Examination (LDCE), with PRTs having at least five years’ regular service eligible for consideration.

¶ 2

It also noted the amended Recruitment Rules dated 20 March 2025, which changed the promotion-to-LDCE ratio to 66.67% and 33.33%, respectively.

¶ 3

The judgment records the applicants’ contention that earlier Recruitment Rules did not prescribe CTET as an eligibility condition for promotion, and notes that the 2026 circular required CTET Paper-I qualification.

¶ 3, 5

The Tribunal relied on its prior decision in Anju Meena & Ors., OA No. 2265/2026, but did not set out its reasoning or formulate a broader legal test in this order.

¶ 7, 9

04Reasoning

The Tribunal treated the issue as whether the applicants could be considered after completing the required service and subsequently qualifying CTET.

¶ 8–9

Having regard to its prior decision in Anju Meena & Ors., it directed that their candidature be considered, while leaving verification of all other eligibility requirements to the respondents.

¶ 8–9

The order does not provide further analysis of the relationship between the applicable Recruitment Rules, the CTET requirement in the circular, and the timing of the applicants’ qualification.

¶ 8–9

05Holding

The Tribunal disposed of the OA by directing the respondents to consider the applicants’ candidature for promotion to Headmaster through the DPC, subject to verification that they satisfy all other applicable eligibility conditions.

¶ 9–11

If an applicant secures the requisite merit position and is otherwise eligible, the respondents must consider that candidature for further stages of the selection process in accordance with law.

¶ 10

Pending miscellaneous applications were also disposed of, with no order as to costs.
