In brief

The question

Whether the discrepancy between the PE&MT measurements and the subsequent hospital measurement warranted a fresh measurement of the applicant’s height by the prescribed method.

The court held

The Tribunal disposed of the OA, directing the respondents to arrange a fresh digital measurement at a Government hospital identified by the competent authority within four weeks of receiving a certified copy of the order.

It also directed

The respondents must then consider the result and the applicant’s candidature under the applicable recruitment rules and eligibility conditions; the direction creates no automatic right to appointment or further participation in the selection process.

No order as to costs was made.

01Facts

The applicant, a candidate for Constable (Driver) Male in the Delhi Police Examination, 2025, had his height recorded as 168.6 cm at the Physical Endurance and Measurement Test (PE&MT) and 167.9 cm on re-measurement following his appeal.

¶ 2

A measurement at the District Civil Hospital, Charkhi Dadri, on 14 October 2026 recorded his height as 170 cm; he sought a fresh measurement and consideration of his candidature.

¶ 3–4

The respondents opposed further measurement, contending that the prescribed procedure had been followed and that an independent measurement did not invalidate the official measurements.

02Issues

i.Whether the discrepancy between the PE&MT measurements and the subsequent hospital measurement warranted a fresh measurement of the applicant’s height by the prescribed method.

¶ 7

03Law Applied

The Tribunal relied on its prior decisions in Abhishek Kumar v. Staff Selection Commission & Ors., OA No. 2813/2021, and Mukul Choudhary v. Staff Selection Commission & Anr., OA No. 503/2024.

¶ 8–10

In Abhishek Kumar, the Tribunal directed a fresh height measurement by digital mode at a Government hospital, noting that Standing Order No. 212/2020 stipulated digital measurement.

¶ 9

Mukul Choudhary applied those directions on parity of reasons.

¶ 10

04Reasoning

The Tribunal considered the differing measurements, including the hospital measurement of 170 cm, sufficient to warrant an opportunity for fresh measurement by digital mode.

¶ 3, 7, 11

Following the approach in Abhishek Kumar and Mukul Choudhary, it treated a fresh measurement at a Government hospital as an appropriate means of resolving the discrepancy.

¶ 11–13

It did not determine the applicant’s ultimate eligibility or treat the hospital measurement as conclusive.

¶ 11–13

¶ 12
