01Facts
The applicants, selected from the ESE-2010 reserve list, joined the Central Water Engineering Services in August and September 2015. They claimed that the delay in operating the reserve list and issuing appointment offers was attributable to the respondents.
¶ 2.1–2.3Although their Junior Time Scale (JTS) seniority was corrected by corrigendum dated 14 October 2016, they were not promoted to the Senior Time Scale (STS) when certain officers said to be their juniors were promoted on 10 May 2016. The applicants were promoted to STS with effect from 29 June 2018, after completing probation. They sought notional promotion from 10 May 2016 and consequential benefits; the respondents relied on the applicants’ reserve-list appointment, extensions of joining time, and the requirement to complete two years’ probation before promotion.
¶ 2.1–2.3, 3.1–3.3, 6.1–6.302Issues
i.Whether the applicants were entitled to notional promotion to STS from 10 May 2016, when their alleged juniors were promoted, despite not having completed the prescribed probation period by that date.
¶ 6.1ii.Whether the delay in the applicants’ appointment and resulting shortfall in probation were attributable to the administration, and what consequences could follow under the applicable service rules and instructions.
¶ 6.4, 6.903Law Applied
The Tribunal recognised that seniority and eligibility for promotion are distinct, and that correction of seniority does not, by itself, establish entitlement to retrospective promotion. It considered the applicants’ reliance on the DoPT O.M. dated 10 June 2015 and on Jeewraj Singh Shekhawat v. Union of India & Ors. and Government of NCT of Delhi & Ors. v. Rakesh Beniwal & Ors.
¶ 6.5–6.7The principles invoked from those authorities require consideration of whether an employee’s inability to meet a qualifying condition resulted from circumstances beyond the employee’s control or from administrative action; they do not automatically dispense with a mandatory eligibility requirement or confer retrospective promotion. The respondents relied on the applicable probation requirement and DoPT instructions dated 11 November 2010. The Tribunal did not determine the ultimate applicability or effect of those rules and instructions, instead directing the competent authority to examine them in light of the facts.
¶ 6.5–6.7, 6.9–6.1004Reasoning
The Tribunal held that the corrected JTS seniority and the applicants’ reserve-list appointment did not, without more, resolve their promotion claim. The decisive question was whether administrative delay caused the applicants to remain short of the required probation period when their alleged juniors were promoted, including whether the applicants’ requests for extensions of joining time affected that conclusion.
¶ 6.4, 6.8–6.10Because the prior rejection did not adequately address these circumstances, the seniority correction, the probation requirement, the cited DoPT O.M.s, and the authorities relied upon, the Tribunal considered a fresh, reasoned examination necessary. It declined to decide the applicants’ substantive entitlement itself.
¶ 6.8–6.1005Holding
The O.A. was disposed of by directing the competent authority to reconsider the applicants’ representations for notional STS promotion from 10 May 2016, examine the circumstances and reasons for the delayed appointment, the effect of the corrected JTS seniority and any joining-time extensions, and apply the relevant rules, instructions, and cited authorities.
¶ 7.1–7.5A reasoned and speaking order was to be passed within three months of receipt of a certified copy of the order. The Tribunal expressed no final opinion on retrospective promotion or consequential monetary benefits; there was no order as to costs.
