In brief

The question

1. Whether the applicant’s height should be measured afresh in accordance with the applicable recruitment rules and instructions.

The court held

The Tribunal disposed of the O.A. with directions for the respondents to arrange a fresh height measurement at an appropriate institution within three weeks of receiving the order.

It also directed

If the applicant meets the prescribed height criteria, the respondents must take the consequential steps concerning his participation in the PE&MT within one week thereafter; if he succeeds in that test and satisfies all other eligibility conditions, he is entitled to appointment.

No order as to costs was made, and any pending miscellaneous applications were also disposed of.

01Facts

The applicant was disqualified from selection for Constable (Executive) Male in the Delhi Police Examination, 2025, after his height was recorded as 168.20 cm against the prescribed minimum of 170 cm.

p. 2

On appeal, it was recorded as 169.60 cm. He relied on a Haryana Police PMT report recording his height as 170.1 cm and sought relief against the decision dated 24 September 2026 declaring him unfit.

p. 2 · p. 3

He also cited a similar order in Dheeraj Kumar v. Union of India & Others, O.A. No. 3999/2026, dated 13 October 2026.

p. 3

02Issues

i.1. Whether the applicant’s height should be measured afresh in accordance with the applicable recruitment rules and instructions.

p. 3

ii.2. Whether, depending on the fresh measurement, the applicant should be permitted to take the PE&MT and considered for appointment.

pp. 3–4

03Law Applied

The application was brought under Section 19 of the Administrative Tribunals Act, 1985.

p. 2

The Tribunal directed that height be measured in accordance with the rules and instructions governing the recruitment, using the same methodology adopted for other candidates.

Administrative Tribunals Act, 1985 Section 19

04Reasoning

The Tribunal considered the differing height records: the Delhi Police measurements remained below the 170 cm requirement, while the applicant’s Haryana Police PMT report recorded 170.1 cm.

pp. 2–3

Without deciding that the applicant met the Delhi Police standard, and noting the comparable relief granted in Dheeraj Kumar, it considered that the interests of justice required a fresh measurement using the prescribed rules and the methodology applied to other candidates.

p. 3

Further action was made conditional on the measurement result and the applicant’s performance in the PE&MT.

pp. 3–4

05Holding

The Tribunal disposed of the O.A. with directions for the respondents to arrange a fresh height measurement at an appropriate institution within three weeks of receiving the order.

pp. 3–4

If the applicant meets the prescribed height criteria, the respondents must take the consequential steps concerning his participation in the PE&MT within one week thereafter; if he succeeds in that test and satisfies all other eligibility conditions, he is entitled to appointment.

pp. 3–4

No order as to costs was made, and any pending miscellaneous applications were also disposed of.
