Motor Vehicles Act, 1988 Section 173
04Reasoning
The Court considered the Tribunal’s award and concluded that the claimant’s fractures warranted an additional ₹20,000 for pain and suffering and ₹20,000 for loss of amenities.
p. 5For loss of future income, it used monthly income of ₹12,500, added 25% for future prospects, and applied a multiplier of 14 and disability of 15%, arriving at ₹3,93,750.
p. 6It also revised the laid-up-period award to ₹37,500, while leaving the other listed heads unchanged.
p. 6The Court therefore partly allowed the appeal and recalculated total compensation at ₹5,84,500 in its table.
pp. 6–705Holding
The appeal was partly allowed, and the Tribunal’s award was modified.
p. 7The operative order states total compensation of ₹5,87,500 and enhanced compensation of ₹1,27,750, with interest at 6% per annum on the enhanced amount from the date of the appeal until realization; it directed the insurer to deposit the enhanced amount within six weeks of receiving the certified judgment.
p. 7The judgment contains an apparent arithmetic inconsistency: the table totals ₹5,84,500, which is ₹1,27,750 above the Tribunal’s award, whereas the operative order states ₹5,87,500 while retaining the same enhancement figure.
