01Facts
The applicant, a Multi-Tasking Staff member appointed under SRO-43 of 1994, was arrested in July 2022 in connection with an NDPS Act case and released on bail in September 2022.
pp. 2–4He alleged that he resumed work and continued in service, but was placed under suspension by order dated 23 July 2026, after departmental charges had been issued in February 2025.
pp. 2–4He challenged the suspension and sought, among other reliefs, reinstatement and subsistence allowance.
pp. 2–4After hearing, he agreed that the O.A. could instead be treated as a comprehensive representation for the respondents to decide; the respondents had no objection to that course.
pp. 2–402Issues
i.1. Whether the O.A. should be treated as a comprehensive representation and decided by the respondents without the Tribunal determining the merits of the suspension.
pp. 3–4ii.2. Whether the applicant should be directed to receive subsistence allowance, subject to his eligibility, entitlement, and the absence of any legal impediment.
p. 403Law Applied
The applicant referred to Rule 31(3) of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956, in support of the maintainability of an appeal against the suspension order.
p. 3The Tribunal did not decide the applicability or effect of that rule, or otherwise determine the legality of the suspension.
p. 4It directed the respondents to decide the applicant’s claims under the applicable statutory provisions, rules, and governing legal framework, and to release subsistence allowance as warranted by law, subject to eligibility and entitlement and provided no legal impediment exists.

04Reasoning
The applicant accepted disposal on the basis of a comprehensive representation, and the respondents did not oppose that course.
pp. 3–4In view of this limited prayer, the Tribunal expressly refrained from expressing any opinion on the merits of the suspension.
pp. 3–4It therefore directed the respondents to consider the O.A., its accompanying documents and any earlier representations, and to issue a reasoned and speaking order.
pp. 3–4The subsistence-allowance direction was likewise made conditional on the applicant’s legal eligibility and entitlement.
pp. 3–405Holding
The O.A. was disposed of without adjudicating the legality of the suspension.
p. 4The respondents were directed to treat the O.A. and related materials as a comprehensive representation, decide it by a reasoned and speaking order in accordance with law, and release subsistence allowance if legally due.
p. 4They were to complete the exercise within six weeks after service of a certified copy of the order and a copy of the O.A.
