Motor Vehicles Act, 1988 Section 173
04Reasoning
The Court found that the claimant’s asserted agricultural income of Rs. 1,50,000 per annum was not established by the RTC, which showed no standing crops.
p. 6 · ¶ 8It therefore applied the KSLSA notional income of Rs. 9,000 per month instead of the Tribunal’s Rs. 6,000.
p. 6 · ¶ 8Although the disability certificate recorded 65% whole-body disability, the Court retained a 15% disability factor in calculating future income loss, yielding Rs. 2,10,600 (Rs. 9,000 × 12 × 13 × 15%).
pp. 6–7 · ¶ 8–9It also increased compensation for pain and suffering, loss of income during the laid-up period, and loss of amenities, while leaving medical expenses and conveyance, nourishment and attendant charges unchanged.
p. 7 · ¶ 905Holding
The Court modified the Tribunal’s award and fixed total compensation at Rs. 3,37,100, with interest at 6% per annum from the date of the petition until realization, excluding the delayed period of 128 days.
pp. 7–8 · ¶ 10The Insurance Company was directed to deposit the compensation within six weeks of receiving the certified judgment.
p. 8 · ¶ 10The appeal was disposed of.
