01Facts
The petitioner, a Principal, was promoted on 28 July 2026 and initially posted at the same school.
¶ 1By order dated 4 November 2026, she was transferred to Government Higher Secondary School, Hastinapur, Morar (Rural), District Gwalior.
¶ 1She challenged the transfer under Article 226, relying on her proximity to retirement and her bedridden son’s chronic neurological condition.
¶ 2The judgment records her retirement date as 30 April 2027 at paragraph 2, but as July 2027 at paragraph 7; it later describes approximately ten months of service remaining.
¶ 2, 7, 10The State opposed the petition, submitting that transfer is an incident of service.
¶ 302Issues
i.1. Whether the transfer order was liable to be interfered with because the petitioner was nearing retirement and the transfer would affect the preparation of her pension papers under the Madhya Pradesh Civil Services (Pension) Rules, 1976.
¶ 7–10, 12ii.2. Whether the Court could interfere with the transfer notwithstanding the limited scope of judicial review in transfer matters.
¶ 6, 10–1203Law Applied
Rules 49, 57 and 59 of the Madhya Pradesh Civil Services (Pension) Rules, 1976 provide for advance identification of employees approaching retirement and preparation of pension papers before retirement; the Court treated those requirements as relevant to transfer decisions affecting employees near retirement.
¶ 5, 7–9The general rule is that transfer is an incident of service and a transferable employee has no vested right to remain at a particular post; courts ordinarily do not interfere unless the order is vitiated by mala fides or violates statutory provisions.
¶ 6, 11–12The Court relied on Virendra Singh v. State of M.P. & Others , W.P. No. 15608/2021, and Smt. Asha Tiwari v. State of M.P. and Others , W.P. No. 21574/2025, concerning transfers of employees nearing retirement and the pension rules.
¶ 5, 7–804Reasoning
The Court accepted that transfer is ordinarily a matter for the administration, but held that this case warranted review because only about ten months of service remained and the pension rules required preparatory work before retirement.
¶ 6–10It considered the reasoning in Virendra Singh and Smt. Asha Tiwari applicable and rejected the State’s reliance on Clause 24 of the Transfer Policy as the sole basis for assessing the petitioner’s case; the issue also had to be considered in light of the pension rules.
¶ 5, 7–9On that basis, the Court characterized the transfer as involving a violation of statutory provisions and distinguished it from an ordinary transfer challenge.
¶ 10, 1205Holding
The Court allowed the challenge to the extent of setting aside the transfer order dated 4 November 2026 insofar as it concerned the petitioner.
¶ 13It directed the respondents to permit her to continue at her present place of posting in Gwalior and discharge her duties as Principal, Higher Secondary School.
