01Facts
The petitioner college, which offered nursing courses, was found unsuitable for the 2024–25 academic year following an inspection referring to a CBI report.
¶ 3–5, 12For 2025–26, the Madhya Pradesh Nurses Registration Council (MPNRC) declined renewal.
¶ 3–5, 12The State Government allowed the college’s appeal on 29 December 2025, finding that the Principal’s experience deficiency had been cured and directing MPNRC to act as per the applicable parameters.
¶ 3–5, 12The order reached MPNRC on 2 January 2026, after the 30 December 2025 deadline for admissions; consequently, no students were admitted for that session.
¶ 3–5, 12The college sought recognition and portal updates, and an order allowing it to apply for 2026–27 as a renewal rather than as a new course, since Rule 6(5) of the Madhya Pradesh Nursing Shikshan Sanstha Manyata Niyam, 2018 would otherwise apply after two consecutive years without recognition or admissions.
¶ 2, 5–602Issues
i.1. Whether, in light of the State Government’s unchallenged order allowing the college’s appeal, the college should be treated as eligible for renewal for 2026–27 rather than as a new applicant under Rule 6(5).
¶ 11–13ii.2. Whether consequential relief should be granted, and on what terms, given the college’s prior deficiency and the absence of admissions for two sessions.
¶ 8–9, 13–1503Law Applied
Rule 6(5) of the Madhya Pradesh Nursing Shikshan Sanstha Manyata Niyam, 2018 provides that where a nursing institution is not recognized for a course for two consecutive years, or admits no students in a course for two years, it must apply for recognition for the new session as a new course.
¶ 11The Court also treated the State Government’s order of 29 December 2025—which allowed the college’s appeal and was not challenged—as final in the circumstances of this case.
¶ 12–13No judicial precedent was cited.
04Reasoning
Although the college’s non-recognition and lack of admissions for two sessions would ordinarily engage Rule 6(5), the State Government had allowed its appeal and found the Principal eligible.
¶ 12–15The order reached MPNRC only after the admission deadline, leaving the college unable to admit students despite succeeding in its appeal.
¶ 12–15Since the order was unchallenged and had attained finality, the Court considered it appropriate, in the peculiar circumstances, not to treat the college as a new institution for 2026–27.
¶ 12–15It nevertheless considered the earlier deficiency sufficient to warrant costs and a low placement among recognized or renewed institutions.
¶ 12–1505Holding
The petition was allowed and disposed of.
¶ 13–16The college was to be treated as seeking renewal, rather than fresh recognition for a new course, for 2026–27.
¶ 13–16The Court imposed costs of ₹5,00,000, payable within one month to the Juvenile Justice Fund, and directed that the college be placed at the bottom of the recognized/renewed institutions for that academic year.
