In brief

The question

Whether the applicant was entitled to the upgraded replacement pay scales notionally from 1 January 1996, rather than from 21 April 2004.

The court held

The Tribunal allowed the application and directed the respondents to grant the applicant the enhanced replacement pay scales notionally from 1 January 1996 and release the arrears within six months of receiving a copy of the order.

It also directed

No costs were awarded.

01Facts

The applicant, a retired Assistant Commissioner of Customs, sought the benefit of upgraded replacement pay scales from 1 January 1996 rather than 21 April 2004, the date from which the upgrades had been granted to officers in his cadre.

¶ 1–4

He contended that similarly placed officers in other departments had received the benefit retrospectively and that the differential treatment was discriminatory.

¶ 3–4

The Tribunal had previously allowed comparable applications, declaring entitlement to notional benefits from 1 January 1996, but limited arrears to three years before filing; the Kerala High Court subsequently upheld the retrospective entitlement while disapproving that limitation.

¶ 8–9

The applicant relied also on the respondents’ implementation of those decisions in other cases.

02Issues

i.Whether the applicant was entitled to the upgraded replacement pay scales notionally from 1 January 1996, rather than from 21 April 2004.

¶ 4–5, 8–10

ii.Whether the applicant was entitled to arrears and consequential refixation of pay and pension on that basis.

¶ 3, 9–11

03Law Applied

The Tribunal applied the consistent decisions of itself and other courts holding that employees in the relevant cadres were entitled to the enhanced replacement scales from 1 January 1996, and that denying that date to similarly placed employees was impermissible.

¶ 5

It relied on its common order dated 3 December 2025, which recognised notional entitlement from that date, and the Kerala High Court’s judgment dated 15 June 2026, which upheld the retrospective entitlement and disapproved limiting arrears to three years.

¶ 8–9

Although the Tribunal’s earlier order had referred to Union of India v. Tarsem Singh, (2008) 8 SCC 648, the High Court’s subsequent ruling meant that the arrears limitation imposed in that order did not apply here.

¶ 9

04Reasoning

The applicant’s claim concerned the same pay-scale issue and cadre parity considered in the earlier Tribunal and High Court decisions.

¶ 8–9

Those decisions established entitlement to the enhanced scales from 1 January 1996, and the High Court had also rejected the earlier restriction on arrears.

¶ 8–9

The Tribunal further noted that the respondents had implemented the resulting directions for other applicants, confirming that the issue was no longer res integra.

¶ 10

It therefore extended the same relief to this applicant.

05Holding

The Tribunal allowed the application and directed the respondents to grant the applicant the enhanced replacement pay scales notionally from 1 January 1996 and release the arrears within six months of receiving a copy of the order.

¶ 11

No costs were awarded.
